لا يمكن تصور حياة الإنسان في المجتمعات المعاصرة بغير تمتعه بالعديد من الحقوق والحريات، وينطلق ذلك بشكل رئيس من أن الإنسان ولد حرا، وعاش دهورا عدة ينعم فيها بحرية مطلقة، قبل أن يتجه بفكره إلى تقييد حقوقه وحرياته بعض الشيء على إثر اجتماعه بغيره وعيشه في
جماعات يحكمها القانون .
والعيش المشترك أوجد حاجة ماسة إلى تخلي الناس عن بعض حقوقهم وحرياتهم، انطلاقا من أن تمتع كل فرد بحقوق وحريات مطلقة لا بد أن يصطدم بحقوق وحريات غيره الطلقة أيضًا، وأن مباشرة الفرد لحقوقه وحرياته لا بد أن تحتد بمباشرة غيره لحقوقه وحرياته، على نحو أصبح فيه تنظيمها لا غنى عنه الاستمرار الحياة داخل الجماعة، وبالتالي تأكد الإنسان أنه بنزوله للعيش في جماعات لا بد
أن يتنازل عن جزء من حقوقه وحرياته لصالح غيره من أفراد الجماعة.
ومع التطور لم تعد حقوق وحريات الإنسان مقيدة بمباشرة حقوق وحريات غيرة من أفراد الجماعة فحسب، بل أصبحت مقيدة أيضًا لصالح الجماعة نفسها كشخص معنوي يمثل كافة الأفراد الذين تربطهم روابط مشتركة، وهذه الجماعة تركزت في صورة القبيلة ثم مر بتطورات كبيرة إلى أن أصبحت في صورة الدولة بشكلها المعاصر التي تحكم بسلطات ثلاث بغرض تنظيم الحياة في كافة ميادينها ومنها الحقوق والحريات التي يحظى بها كل فرد في الدولة، خاصة تلك التي لا يستطيع الإنسان أن يحيا بدونها .
