لا يمكن تصور حياة الإنسان في المجتمعات المعاصرة بغير تمتعه بالعديد من الحقوق والحريات، وينطلق ذلك بشكل رئيس من أن الإنسان ولد حرا، وعاش دهورا عدة ينعم فيها بحرية مطلقة، قبل أن يتجه بفكره إلى تقييد حقوقه وحرياته بعض الشيء على إثر اجتماعه بغيره وعيشه في<br/>جماعات يحكمها القانون .<br/>والعيش المشترك أوجد حاجة ماسة إلى تخلي الناس عن بعض حقوقهم وحرياتهم، انطلاقا من أن تمتع كل فرد بحقوق وحريات مطلقة لا بد أن يصطدم بحقوق وحريات غيره الطلقة أيضًا، وأن مباشرة الفرد لحقوقه وحرياته لا بد أن تحتد بمباشرة غيره لحقوقه وحرياته، على نحو أصبح فيه تنظيمها لا غنى عنه الاستمرار الحياة داخل الجماعة، وبالتالي تأكد الإنسان أنه بنزوله للعيش في جماعات لا بد<br/>أن يتنازل عن جزء من حقوقه وحرياته لصالح غيره من أفراد الجماعة.<br/>ومع التطور لم تعد حقوق وحريات الإنسان مقيدة بمباشرة حقوق وحريات غيرة من أفراد الجماعة فحسب، بل أصبحت مقيدة أيضًا لصالح الجماعة نفسها كشخص معنوي يمثل كافة الأفراد الذين تربطهم روابط مشتركة، وهذه الجماعة تركزت في صورة القبيلة ثم مر بتطورات كبيرة إلى أن أصبحت في صورة الدولة بشكلها المعاصر التي تحكم بسلطات ثلاث بغرض تنظيم الحياة في كافة ميادينها ومنها الحقوق والحريات التي يحظى بها كل فرد في الدولة، خاصة تلك التي لا يستطيع الإنسان أن يحيا بدونها . |

It is not possible to imagine human life in contemporary societies without enjoying many rights and freedoms, and this stems mainly from the fact that man was born free, and lived for many centuries enjoying absolute freedom, before he turned his mind to somewhat restricting his rights and freedoms as a result of his meeting with others and living in groups. Governed by law.<br/>Coexistence has created an urgent need for people to give up some of their rights and freedoms, based on the fact that each individual's enjoyment of absolute rights and freedoms must come into conflict with the absolute rights and freedoms of others as well, and that an individual's exercise of his rights and freedoms must be combined with others' exercise of his rights and freedoms, in a way that has become Its organization is indispensable for the continuation of life within the group, and therefore a person is certain that by descending to live in groups, he must give up part of his rights and freedoms in favor of other members of the group.<br/>With development, human rights and freedoms were no longer restricted only to exercising the rights and freedoms of other members of the group, but they also became restricted for the benefit of the group itself as a legal entity representing all individuals with common ties. This group was concentrated in the form of a tribe and then went through major developments until it became in the form of a state. In its contemporary form, it is governed by three authorities for the purpose of organizing life in all its fields, including the rights and freedoms that every individual in the state enjoys, especially those without which a person cannot live. |
