نتيجة تحول الفكر الاقتصادي في الكويت نحو استخدام عائدات النفط في إنشاء البنية التحتية، وتنوع مجالات الاستثمارات، ما أدى إلى التوسع في مجالات المقاولات، وانتشار المباني الضخمة والأبراج المكونة من عشرات الأدوار، وظهور أعمال جديدة، لم تكن موجودة من قبل. فضلاً عن ارتفاع مستوى المعيشة للمجتمعات، مما أدى إلى المطالبة بتحقيق الازدهار والرفاهية، من خلال إتقان العمل، وتسليمه في المواعيد المحددة، لتقليل التكلفة، وتحقيق المزيد من الربح المالي، وتجنب المخاطر، نتيجة لكل ما سبق شهدت بداية القرن الحادي والعشرين إقبالاً متزايداً على عقود المقاولة من الباطن. بغرض تنفيذ العمل بكامله، أو في تنفيذ بعض أجزائه، بما يتوفر للمقاول من الباطن من خبرة متراكمة، وتخصص في مجال عقد المقاولة من الباطن، ما لم يكن عقد المقاولة الأصلي يتضمن شرطاً يحظر اللجوء إلى المقاولة من الباطن، إذا ما اعتبر ذلك تنازلاً عن العقد، كما هو الحال مع مقاولة الباطن فيما يقدمه من مهنية أو معنوية، مثل وضع الرسومات، والتصميمات الهندسية الخاصة بالمشروع محل عقد المقاولة، أو وجد نص قانوني يحظر اللجوء إلى المقاولة من الباطن. |
