لقد تم تقسيم هذه الرسالة إلى ثلاثة أقسام، حاولت من خلالها التطرق إلى موضوع حقوق المرأة بين الاتفاقيات الدولية و التشريعات العربية، و في إيطار القانون المقارن اخترت نموذج المغرب و مصر. و قد شمل القسم الأول تطور حقوق المرأة في التشريع الدولي من حيث المرجعيات أو المصادر الدولية للمساواة و المناصفة باعتبارهما الأساس الصلب لحقوق المرأة. و انقسمت هذه المرجعيات إلى مرجعيات دولية عامة و مرجعيات إقليمية خاصة بحقوق الإنسان، و مرجعيات دولية خاصة بقضايا المرأة. و القسم الثاني شمل التشريعات المغربية و المصرية الخاصة بحقوق المرأة و مسارات النقاش حول المساواة و المناصفة و المحطات الرئيسية لهذا النقاش في السياقين المصري و المغربي و انعكاسه على تشريع البلدين، كما يخص أيضا محددات التأطير القانوني للمساواة و المناصفة في البلدين. أما القسم الثالث هو حول حدود التأطير القانوني للمساواة و المناصفة في كل من مصر و المغرب، و يشمل تجليات حدود التأطير القانوني و أسباب حدوده، و كذا الممارسة الاتفاقية لكل من مصر و المغرب.
This dissertation has been divided into three sections, through which I have tried to address the issue of women's rights between international conventions and Arab legislation. Within the framework of comparative law, I chose the example of Morocco and Egypt.
The first section included the development of women's rights in international legislation in terms of references or international sources of equality and parity, given that they are the solid foundation for women's rights. These references were divided into general international references, regional references for human rights, and international references for women's issues.
The second section covered Moroccan and Egyptian legislations on women's rights, tracks of discussion on equality and parity, the main stations of this discussion in the Egyptian and Moroccan contexts, and their reflection on the legislation of the two countries, as well as the determinants of the legal framework for equality and parity in the two countries.
As for the third section, it is about the limits of the legal framework for equality and parity in both Egypt and Morocco, and it includes the manifestations of the limits of legal framework and the reasons for its limits, as well as the consensual practice of both Egypt and Morocco.
