لم تعد الحماية القانونية لحقوق الملكية الفكرية أمراً قابلاً للتشكيك، سواء من ناحية اعتبارها حقوقاً بالفعل، أو من ناحية أهميتها التي تتزايد يوماً بعد يوم.
وبناء على ذلك، فقد فطن المشرعون سواء على المستوى الوطني، أو على المستوى الدولي فبادروا بوضع ما يناسب من التشريعات، وإبرام الاتفاقيات الدولية في سبيل ضبط ما ينتج من ابتكار أو استغلال لهذه الحقوق، من مستجدات قانونية تفرض نفسها.
فعلى المستوى الوطني، ينبغي على المشرع أن يكون في وضع الاستعداد دائماً؛ لتلقي أية مشكلات تطراً بخصوص حقوق الملكية الفكرية، خاصة في ظل التطورات التكنولوجية المتلاحقة التي تؤكد على استمرارية المواجهة التشريعية لما يستجد من أوضاع.
ذلك أن انتشار وسائل التواصل فيما بين الأشخاص حول العالم، سواء من خلال المواقع الإلكترونية، أو المنصات والتطبيقات الذكية. مما أدى إلى تطورات عميقة في مفاهيم الملكية الفكرية.

The legal protection of intellectual property rights is no longer questionable, whether in terms of considering them as rights in fact, or in terms of their increasing importance day after day. Accordingly, legislators, both at the national and international levels, have become aware and have taken the initiative to develop appropriate legislation and conclude international agreements in order to control the resulting innovation or exploitation of these rights, from legal developments that impose themselves.
At the national level, the legislator must always be prepared to receive any problems that arise regarding intellectual property rights, especially in light of the successive technological developments that emphasize the continuity of legislative confrontation with emerging situations.
This is because the spread of means of communication between people around the world, whether through websites, platforms or smart applications, has led to profound developments in the concepts of intellectual property
