الجريمة ظاهرة اجتماعية عاصرت جميع المجتمعات الإنسانية عبر العصور المختلفة قديما وحديثا، فهي مرتبطة بالاجتماع الإنساني، فأينما وجدت التجمعات الإنسانية وجدت الجريمة، والبحث في مجال الجريمة ليس بالجديد؛ ولذلك تأثرت
الجريمة بكافة المعطيات المحيطة بها، واختلفت باختلاف الزمن في المجتمع ذاته. وقد أدت التغيرات التي مرت بها المجتمعات المختلفة من أحداث اجتماعية،
وسياسية، واقتصادية إلى إحداث تغيرات في كمية الجريمة ونوعها.
وفي ظل الثورة الرقمية التكنولوجية التي يعيشها المجتمع، تطورت الجريمة لتظهر في ثوب جديد مختلف عن الشكل التقليدي المتعارف عليه لها، نتج عن تسخير الجاني كل ما توصلت إليه العلوم التقنية والتكنولوجية وتطويعها في خدمة الجريمة؛ مما أدى إلى صعوبة احتوائها بموجب النصوص القانونية القائمة وضرورة صياغة
نظرية عامة لهذا النوع من الجرائم تتضمن قواعد وأحكامًا جديدة تتواءم معها،
وتلحق بقانون العقوبات بقسمية العام والخاص.

Crime is a social phenomenon that has occurred in all human societies across different eras, ancient and modern. It is linked to human society. Wherever there are human gatherings, there is crime. Research in the field of crime is not new, and therefore crime was affected by all the data surrounding it and differed with time in society itself.
The changes experienced by different societies, including social, political, and economic events, have led to changes in the quantity and type of crime.
In light of the digital technological revolution that society is experiencing, crime has developed to appear in a new guise different from its traditional, conventional form. The perpetrator has resulted in harnessing everything that technical and technological sciences have achieved and adapting it to serve the crime. This has led to the difficulty of containing it according to the existing legal texts and the necessity of Formulating a general theory for this type of crime that includes new rules and provisions that are compatible with it, and is attached to the Penal Code with a general and special division.
