إن المعاينة هى سبيل التحقيق الجنائى للبحث عما يخلفه ارتكاب الجريمة من آثار مادية تنتج أدلة وقرائن صالحة للإسناد: و دراسة دور المعاينة فى الإثبات يقوم على الدمج بين جانبين أحدهما قانونى و الأخر فنى: و ينبنى الجانب القانونى لدراسة المعاينة على بحث تنظيم المشروع الجنائى لها لإظهار أوجه الشبه بين التشريع المصرى و العربى و الأجنبى و أوجه القصور فيها: كذلك ما تخضع فيه المعاينة كإجراء قانونى للقواعد العامة: إضافة إلى ذلك توضيح الفرق بين الدليل الذى يقطع بتواجد المتهم على مسرح الجريمة و دليل المساهمة فى ارتكاب الفعل المادي للجريمة. أما الجانب الفنى يفترض بحث مراحل الاتصال المباشر بالأثر المادى و تشمل على البحث و الإظهار ثم المعاينة يليها الرفع و التحريز: و يتعين على مأمور الضبط و المحقق الاستعانة بخبير فنى متخصص لدعم موثوقية الأدلة المادية أمام القاضى الجنائى
