يطالعنا العلم كل يوم بالجديد في المجال العلمي؛ مما أدى إلى إفراز بعض التقنيات الطبية الحديثة، إلا أنها قد تؤثر تأثيرا سيئا على الإنسان وصحته، بل قد تؤدي إلى تدميره في أحيان أخرى، مثل نقل وزراعة الأعضاء وإخضاع جسم الإنسان للتجارب الطبية والاستنساخ من خلال الهندسة الوراثية، بالإضافة إلى تقنية العلاج بالخلايا الجذعية حيث يتوجب دراسة مدى مشروعيتها لمساسها بمعصومية جسم الإنسان، إضافة إلى إعلان بعض السيدات عن رغبتهن في تأجير أرحامهن. وقد قمنا في هذا البحث بدراسة مدى مشروعية التصرف في الأعضاء الآدمية، وتوضيح رأي الشريعة الإسلامية، والمشرع المصري من التصرف في الأعضاء البشرية، ووضع بعض القواعد القانونية والشرعية لهذا التصرف، ومن ثم محاولة الوصول إلى معيار حقيقي للوفاة باعتبارها النقطة الجوهرية في استقطاع أعضاء المتوفى، وموقف الشريعة الإسلامية والقانون من هذا التصرف، وبيان حكم التطبيقات الحديثة لها مثل الاستنساخ والهندسة الوراثية والخلايا
الجذعية.

In this study, we examined the legality of the behavior of human organs, clarifying the opinion of the Islamic Law and the Egyptian legislator on the disposition of human organs and the establishment of some legal and legal rules for such behavior, and thus attempting to reach a true standard of death, And the position of Islamic law and law on this behavior, and the statement of the rule of modern applications such as cloning, genetic engineering and stem cells.
