منذ هجمات 11 سبتمبر ۲۰۰۱ في مدينة نيويورك بالولايات المتحدة الأمريكية، ازداد الاهتمام بالكيانات المسلحة من غير الدول على الساحة الدولية، خاصة مع تزايد النزاعات المسلحة غير الدولية التي تكون هذه الكيانات طرفا فيها. وعلى الرغم من التركيز المتزايد عليها في الأدبيات السياسية، لا يزال هناك غياب واضح لإطار قانوني يحدد مسؤوليات هذه الكيانات عن الانتهاكات التي ترتكبها أثناء النزاعات أو بعدها في ظل هذه الفجوة، يتم التعامل مع أعضاء هذه الكيانات بشكل فردي، وبحسب كل حالة على حدة، باستخدام آليات قانونية غير ملائمة لطبيعة الجرائم الجماعية الجسيمة التي ترتكبها هذه الكيانات.
من هذا المنطلق، ارتأت الباحثة ضرورة المساهمة في وضع إطار قانوني شامل يتناول الكيانات المسلحة من غير الدول من منظور قانوني بعيدًا عن الاعتبارات السياسية، لا سيما في ضوء تركيز الأدبيات العربية على تناول هذه الكيانات من زاوية الإرهاب فقط. وتهدف الدراسة إلى المساهمة في سد هذه الفجوة الأكاديمية من خلال طرح إطار قانوني عام يتناول المسؤولية الجنائية لهذه الكيانات على الساحة الدولية.
بناءً على ما تقدم، تنقسم الرسالة إلى بابين رئيسيين الباب الأول يتناول الإطار القانوني العام للكيانات المسلحة من غير الدول، مع التركيز على ماهيتها وتحليل وضعها القانوني على المستوى الدولي. أما الباب الثاني، فيناقش قواعد المسئولية الدولية ومدى إمكانية تطبيقها على الكيانات المسلحة من غير الدول"، حيث يركز على الإطار الحالي للمسئولية الدولية وعلاقته بهذه الكيانات، إضافة إلى محاولات الفقه لتكريس مسؤوليتها. وتُختتم الرسالة بتوصيات تهدف إلى تطوير الإطار القانوني الدولي لضمان محاسبة هذه الكيانات على انتهاكاتها.

Since the September 11, 2001 attacks in New York City, there has been growing international focus on Armed Non-State Actors, particularly with the rise of non-international armed conflicts involving these armed groups. Despite the attention they receive in political literature, there remains a significant gap in establishing a clear legal framework that defines their responsibilities for violations committed during or after such conflicts. In the absence of such a framework, these entities are often dealt with on a case-by-case basis, using legal mechanisms ill-suited to address the collective nature of the grave crimes they commit.
Recognizing this gap, the researcher seeks to contribute to the development of a comprehensive legal framework for Armed Non-State Actors, focusing on their legal responsibilities rather than political considerations. This is especially important given the predominant focus in Arab literature on framing these entities solely through the lens of terrorism. The study aims to bridge this academic gap by proposing a legal framework that addresses the international criminal responsibility of these entities.
The dissertation is divided into two main chapters: The first chapter, "The General Legal Framework for Armed Non-State Actors, explores their nature and legal status at the international level. The second chapter, "The International Responsibility of Armed Non-State Actors, examines the existing international responsibility framework and efforts to establish their accountability. The study concludes with recommendations to develop the legal framework necessary for holding these entities accountable for their violations.
