لا شك في تربع موضوع المسئولية المدنية قمة الموضوعات التي تشغل أذهان الباحثين، لكونها حجز الزواية لنشوء التعويض الذي يرأب الصدع الناشئ للطرف الذي يلحق به الضرر، ولذا ينشأ صراع الأطراف ويختلف الفقهاء حول أساسها في مختلف النظم القانونية، وهو ما يجعلها محلاً للتجديد المستمر حتى تستجيب للمقتضيات الاجتماعية والاقتصادية، ونظراً للدور الهام الذي يقوم به الاستشاري في عقود نقل التكنولوجيا والعلاقات المتشابكة التي ينخرط فيها مما قد يفضي إلى قيام مسئوليته المدنية، فقد قمنا بالبحث في عقد تقديم المشورة في عقود نقل التكنولوجيا، ودور الاستشاري - مقدم المشورة ، وأنواع المسئولية وأساسها القانوني والقواعد الحاكمة لتلك العلاقات وذلك لبيان ما إذا كانت صالحة - وفقاً للقواعد العامة بالقانون لحكم هذا العقد بما يحمله من مخاطر، أم اننا بحاجة لتنظيم قانوني كامل لهذا العقد وللقواعد التي تحكم تلك العلاقة من قواعد المسئولية الموضوعية، وكذلك بيان مسألة التأمين

There is no doubt that the topic of civil liability occupies a central place in the minds of researchers, as it is the cornerstone for the emergence of compensation that remedies the damage caused to the injured party And that is the reason why the conflict competence, the jurists' opinion of its foundation in various legal systems is different which makes it constant renewal till the response to social and economic demands. Given the important role consultants play in technology transfer contracts and the complex relationships they engage in, which may cause the civil liability, we have investigated in consulting contacts within technology transfer contracts, the role of the consultant( consultancy giver) and the types and legal foundations of liability, and the legal rules which govern those relations to determine whether it's valid according to general legal rules - to carry this contract with its inherited risks, or if a comprehensive legal framework is needed. this includes rules on strict liability, the effects of liability's establishment, the parties involved in liability claims, compensation regulations, and the issue of liability insurance inside these contracts.
