شهدت البشرية في نهاية القرن العشرين وبداية هذا القرن تطورا هائلا في وسائل الاتصال وتقنياته جعلت السلوك الإنساني يتغير في مختلف الجوانب الاقتصادية والثقافية
والاجتماعية والقانونية أيضا. وأدى عصر المعلوماتية وما نتج عنه من تطورات في المعاملات التجارية إلى تطور التجارة في كل نواحيها وسهل على التجار والعملاء إدارة تجارتهم وإتمام
معاملاتهم.
وقد ساعد التطور المستمر لوسائل نقل المعلومات وتقنيات الاتصال على إيجاد روابط أكثر سرعة وأقل كلفة بين الأفراد في شتى بقاع العالم، وكان طبيعيا في هذه البيئة التقنية أن يستخدم الإنسان هذه الوسائل المتطورة في نقل إرادته والتعبير عنها، وهذا ما كان سببا رئيسا وراء انتشار طائفة جديدة من العقود أطلق عليها العقود الإلكترونية نسبة
إلى الوسيلة التقنية والتكنولوجية المستخدمة في إبرامها . وعلى نحو متسارع جدا بدأ الإنسان يخطو خطوات متلاحقة نحو إبرام معاملاته وتصرفاته القانونية باستخدام تلك الوسائل التقنية، نتيجة لما توفره من ظروف تتيح تبادل
الإرادتين بصورة فورية لا تعترف بالحدود أو العوائق المادية. وتعد شبكة الإنترنت من أهم الابتكارات التي توصل إليها العقل البشري في مجال المعلوماتية منذ أواخر القرن المنصرم، حيث أزالت الحدود الجغرافية بين الدول
وساعدت في تحويل العالم إلى قرية صغيرة، وفي هذا السياق ظهرت وتطورت التجارة الإلكترونية، وأصبح الإنترنت من أهم الوسائل التي يتم من خلالها إبرام العقود الإلكترونية.

At the end of the twentieth century and the beginning of this century, humanity witnessed tremendous development in means of communication and its technologies, which made human behavior change in various economic, cultural, social and legal aspects as well.
The information age and the resulting developments in commercial transactions led to the development of trade in all its aspects and made it easier for merchants and customers to manage their trade and complete their transactions.
The continuous development of means of transmitting information and communication technologies has helped to create faster and less expensive connections between individuals in various parts of the world, and it was natural in this technical environment for humans to use these advanced means to convey and express their will, and this was a major reason behind the spread of a new sect. Of the contracts, they are called "electronic contracts" in reference to the technical and technological means used to conclude them.
In a very rapid manner, humans began to take successive steps toward concluding their legal transactions and actions using these technical means, as a result of the conditions they provide that allow the exchange of two wills in an instant that does not recognize borders or physical obstacles.
The Internet is considered one of the most important innovations that the human mind has reached in the field of information since the end of the last century, as it removed geographical boundaries between countries and helped transform the world into a small village. In this context, electronic commerce appeared and developed, and the Internet became one of the most important means through which Concluding electronic contracts.
