عالجت الدراسة موضوع "المبادئ التى أرستها المحكمة الدستورية العليا فى القانون الإدارى (دراسة مقارنة)"، وذلك من خلال تتبع رقابة الدستورية منذ نشأة المحكمة العليا ومن بعدها المحكمة الدستورية العليا فى مصر، وكذلك المجلس الدستورى الفرنسى فى فرنسا - رغم اختلاف طبيعة وأسلوب الرقابة - وقد أرسى القضاء الدستورى المصرى والفرنسى العديد من المبادئ الدستورية فى شأن وسائل النشاط الإدارى والتى تتمثل فى الوظيفة العامة، والأموال العامة، كما أرسى العديد من المبادئ الدستورية فى شأن أساليب النشاط الإدارى والتى تتمثل فى القرارات واللوائح الإدارية والعقود الإدارية. كما بينا هذه المبادئ التى أرستها المحكمة العليا ومن بعدها المحكمة الدستورية العليا فى مصر، وكذلك المبادئ التى أرستها قرارات المجلس الدستورى الفرنسى فى فرنسا وتحليليها، وأوضحنا موقفنا من هذه المبادئ وفقًا للأسانيد الدستورية، وعرضنا بعض النصوص التى قد تشوبها شبهات عدم الدستورية والمرتبطة بالموضوعات محل الدراسة، والتى لم تعرض على القضاء الدستورى للفصل فى مدى دستوريتها، أو عرضت عليه ولم يتم الفصل فيها حتى تاريخ طبع الرسالة، كما انتهينا بالعديد من النتائج التى ترتبت على بيان هذه المبادئ الدستورية للموضوعات محل البحث، وأوصينا بالعديد من التوصيات سواء للقضاء الدستورى أو للمشرع الدستورى والتشريعى واللائحى التى نأمل أن ترى النور فى الحياة العملية.

This study has addressed "the principles established by the Supreme Constitutional Court in the administrative law (comparative study)" throughout monitoring the control of the Supreme Court and afterwards the Supreme Constitutional Court of Egypt upon the constitutionality of the laws and regulations. Along with the control of the Constitutional Council of France in spite of their differences in nature and methods. The Egyptian and French Constitutional jurisprudence have established many constitutional principles concerning means of administrative activities which are represented in public service and public funds. Furthermore, they have established many constitutional principles concerning the methods of administrative activity, represented in the administrative decisions, regulations and administrative contracts. This study has outlined and analyzed the principles established by the Supreme Court and afterwards "The Supreme Constitutional Court of Egypt", as well as the principles established by the decisions of the Constitutional Council in France. This study highlighted a point of view towards these principles in accordance with the constitutional principles. It also, presented some provisions that may be subject to suspicion of unconstitutionality and affiliated to subjects under study that have not been submitted to the Constitutional Court to adjudicate their constitutionality or submitted and haven't been adjudicated till the publishment of this study. The study has also reached many conclusions that have resulted from the statement of these constitutional principles of the subjects under this study and stated some recommendations for the constitutional judiciary, the constitutional, legislative and regulatory bodies that we hope will be put into action.
