سهّل التطور في الوسط المعلوماتي ارتكاب الكثير من الجرائم، ولم تعد آثارها محصورة في النطاق الإقليمي لدولة بعينها؛ الأمر الذي بات يثير بعض التحديات القانونية والعملية أمام الأجهزة المعنية بمكافحة الجريمة (أجهزة العدالة الجنائية بجميع مستوياتها وعلى اختلاف أدوارها). وتتمثل الجريمة المعلوماتية فى كل سلوك غير مشروع أو منافٍ للأخلاق أو غير مسموح به يرتبط بالمعالجة الآلية للبيانات أو بنقلها، أو فى أنها الأفعال الإجرامية الناتجة من خلال أو بواسطة استخدام المعلوماتية أو التقنية الحديثة المتمثلة فى الكمبيوتر، أو أي من الوسائط الالكترونية الأخرى. ويتم انتهاك حرمة الحياة الخاصة عبر الوسط المعلوماتي من خلال الدخول على موقع بدون تصريح، أو الاستيلاء ونشر فحوصات طبية أو تشخيص طبي وسجلات طبية أو مالية أو غيرها تخص الغير، وكذلك تغيير تصاميم الموقع الخاص به أو حذفه، وأيضًا استراق السمع أو تسجيل أو نقل أو بث أو إفشاء محادثات له، وكذلك التقاط صور الغير ونقلها أو كشفها ... إلخ.
