أصبح التعامل الإلكتروني في العصر الحديث من أهم طرق التعامل ، فبالإمكان إبرام عقود التجارة الإلكترونية بسهولة تامة رغم التباعد المكاني بين المتعاقدين، وأصبح العالم يشكل قرية صغيرة، ونظراً لأن هذه العقود قد تبرم بين أطراف لا يعرف بعضهم بعضاً ، كان لا بد من استشراف عدة إجراءات قانونية وتقنية من شأنها توفير الضمانات والوسائل التي تكفل تحديد هوية المتعاقدين ومدى أهليتهما للتعاقد وبطريقة سليمة يمكن معها نسبة التصرف إلى صاحبه ، لا سيما في ظل تنامي القرصنة الإلكترونية والأنشطة غير المشروعة عبر شبكة الإنترنت. وفي سبيل تحقيق هذا الهدف يتم الاستعانة بطرف ثالث محايد يلعب دور الوسيط بين المتعاقدين لتوثيق معاملاتهم الإلكترونية لذلك فإن توفر عنصر الأمان والثقة ضروري لتطوير التجارة الالكترونية، التي تعتمد على شبكة اتصال مفتوحة؛ لذا فقد ارتأت التشريعات الدولية والوطنية ضرورة إيجاد طرفثالث محايد، وهو ما أطلق عليه قانون التوقيع الإلكتروني المصرى ١٥ لسنه ۲۰۰٤ تسمية « جهات التصديق الإلكتروني » والذي يعرف على أنه

Electronic dealing has become one of the most important ways of dealing in the modern era, it has become possible to conclude e-commerce contracts quite easily despite the spatial distance between contractors, and the world has become a small village, and because these contracts may be concluded between parties who do not know each other. It was necessary to foresee several legal and technical procedures that would provide guarantees and means to ensure the identification of the contractors and their eligibility to contract in a proper manner with which the disposal can be attributed to its owner, especially in light of the growing electronic piracy and illegal activities via the Internet. In order to achieve this goal, a neutral third party plays the role of mediator between contractors to document their electronic transactions, so the availability of an element of security and trust is necessary for the development of e-commerce, which depends on an open communication network. Therefore, international and national legislation has considered the need to find a neutral third party, which is what the Egyptian Electronic Signature Law 15 of 2004 called <«electronic certification bodies», which is defined as a competent authority licensed to issue electronic certification certificates.
