يلقي الإرهاب بعواقبه الوخيمة تحديات سياسية وأمنية واقتصادية خطيرة على عاتق الدولة، الأمر الذي يبرر اتخاذ كل التدابير الكفيلة بمحاربة الإرهاب. ويجب عند اتخاذ هذه التدابير مراعاة التوازن بين قيم الحرية وقيم الأمن. فلا يمكن إنكار العلاقة بين الإرهاب وحقوق الإنسان، فالإرهاب يهدد التمتع ببعض حقوق الإنسان، ويهدد الأمن القومي والنظام العام. وقد يكون من شأن محاربة الإرهاب المساس بقدر من بعض حقوق الإنسان. على أن المشكلة لا تقف عند هذا الحد، بل تثور مشكلة أخرى هي وسيلة مكافحة الإرهاب، لأن هذه الوسيلة يمكن أن تكون لها آثار بعيدة المدى على مدى احترام حقوق الإنسان. وهذه المشكلة ليست بالجديدة، لأن التداخل بين الأمن القومي وحقوق الإنسان كان دائما أحد الموضوعات الشائكة في القانون الدولي ولهذا بدت التحديات القانونية لمكافحة الإرهاب مهمة وحاسمة في ظل عصر سادت فيه قيم دولة القانون، والديمقراطية وحقوق الإنسان، التي أصبحت جزءا من الضمير العالمي. ومن هنا احتلت مُكافحةجريمة الإرهاب جانبا مهما من مسئوليات النظام القانوني حتى تتم المكافحة من خلال التوازن بين متطلبات مكافحة الإرهاب في منع الجريمة أو العقاب عليها، وبين متطلبات حماية حقوق الإنسان. فبغير الثقة في النظام القانوني وسيادة القانون يكون الكفاح ضد الإرهاب ناقصاً.ولهذا واجهت النظم القانونية مسئولية مزدوجة تجاه حقوق الإنسان؛ فمن ناحية أصبحت هذه النظم ملتزمة بمحاربة الإرهاب حماية لحقوق الإنسان، ومن ناحية أخرى تلتزم هذه النظم بالتأكد من أن التدابير المناهضة للإرهاب لا تخرج عن نطاق احترام حقوق الإنسان. ونؤكد أن سلاح الإرهاب يجب أن يواجه بسلاح العدالة.

Terrorism, with its severe consequences, poses serious political, security and economicchallenges to the state, which justifies taking all necessary measures to combat terrorism. Whentaking these measures, the balance between the values of freedom and the values of security mustbe taken into account. The relationship between terrorism and human rights cannot be denied.Terrorism threatens the enjoyment of some human rights, and threatens national security andpublic order. Fighting terrorism may affect some human rights. However, the problem does notstop there. Rather, another problem arises, which is the means of combating terrorism, becausethis method can have far-reaching effects on the extent of respect for human rights. This problemis not new, because the overlap between national security and human rights has always been oneof the thorny issues in international law. Therefore, the legal challenges to combating terrorismseemed important and decisive in an era in which the values of the rule of law, democracy andhuman rights prevailed, which have become part of the global conscience. Hence, combating thecrime of terrorism occupied an important aspect of the responsibilities of the legal system untilthe fight is carried out through a balance between the requirements of combating terrorism inpreventing or punishing the crime, and the requirements of protecting human rights. Withouttrust in the legal system and the rule of law, the fight against terrorism is incomplete. That is whylegal systems faced a double responsibility for human rights; On the one hand, these regimeshave become committed to fighting terrorism in order to protect human rights, and on the otherhand, these regimes are obligated to ensure that counter-terrorism measures do not fall outsidethe scope of respect for human rights. We stress that the weapon of terrorism must be confrontedwith the weapon of justice.
