خصصت هذه الدراسة: لبحث الحماية الجنائية لبصمة الحمض النووى و الفحوصات الوراثية دراسة مقارنة فى الشريعة الإسلامية و القانون: و قسمت الدراسة الى مقدمة: و فصل تمهيدى: و بابين رئيسيين: أما الفصل التمهيدى فقد كان مخصصا لدراسة بعض المفاهيم التى تتعلق بالرسالة: و جعلت الباب الأول مخصصا لبحث الحماية الجنائية التى يجب أن تتوفر عند فحص الحمض النووى و ما يترتب عليه من من مسائل تتعلق بسرية المعلومات الوراثية و أهمية هذه المسألة فى الفقه الإسلامى و القانون، و خصصت الباب الثانى لبحث الحماية الجنائية للفحوصات الوراثية فى الفقه الإسلامى و القانون: و العديد من المسائل التى تتعلق بهذه الجزئية و حكمها فى الفقه الإسلامى: مع إبداء الرأى القانونى و الترجيح عند الإختلاف: و خلصت فى النهاية إلى بعض النتائج و التوصيات الهامة التى خرجت بها الدراسة: من حيث أهمية توفير حماية جنائية لكل من فحص الحمض النووى و الفحوص الوراثية: و عدم تركها بدون تقنينات: فى الوقت الذى تسارع فيه الدول إلى إمتلاك زمام المعلومات الوراثية و استخدامها بكل الطرق الممكنة لتحقيق سيادة علمية: تسلبنا حق التصرف فى أهم ما يتعلق بنا و هو معلوماتنا الوراثية فى الصحة و المرض

This study, entitled (The criminal protection of the DNA signature and genetic tests, is a Comparative Study between Islamic Sharia and Law), which included, an introduction, an introductory chapter, two main sections, and a conclusion which included the main conclusions and recommendations of the study. The study, As for the introductory chapter, I explained the most important concepts contained in the title, namely: criminal protection, DNA and genetic testing.
The first section entitled, Criminal Protection of DNA signature, in Islamic Jurisprudence and Law, divided into three chapters, the first chapter entitled: Criminal protection of the confidentiality of genetic information and who has the right to access it. Which dealt with a number of issues in three sub-sections, then we moved to Chapter two: criminal protection of genetic information from abuse. In the third chapter: Areas of DNA use. I spoke about the uses of DNA in three sub-sections
And the second section of the criminal protection of genetic tests in Sharia and law. It came in three chapters also. , the first on the legality of the genetic tests and the reasons for resorting to them. And in the second chapter I spoke about the criminal protection of the Embryo in genetic testing. And the third and last chapter of this study was titled "Criminal Protection of Human in Genetic Tests" The first sub-section was devoted to the discussion of the criminal protection of the human right to the integrity of his body. The second sub-section was on genetic testing for clinical trials. The third sub-section was on genetic testing for the treatment of incurable diseases. Through the first demand: Treatment of incurable disease. Which included the definition of incurable diseases and the identification of types of incurable diseases. The second demand was to explain the treatment of intractable diseases in stem cells. And the statement of what it is, its importance, types and sources, and I made the third sub-section to show the Sharia and legal controls of stem cells.
- In Conclusion, it included the most important findings and recommendations of the study, which stressed the importance of activating the criminal protection of both DNA signature and genetic testing as a contemporary jurisprudential need, which requires more effort and attention from researchers and scholars to explain it and to indicate what is related to it, and the identification of its provisions and disciplines of jurisprudence and legal. And Allah guide me.
