تعد المسئولية القانونية عن الأضرار جزءاً أساسياً في كل نظام قانوني، ويتوقف مدى فعالية النظام القانوني على مدى نضوج قواعد المسئولية فيه. بيد أن الأضرار البيئية تتسم بطبيعة خاصة، حيث تثير تلك الأضرار في بعض صورها العديد من المشاكل القانونية، والتي تقف المسئولية المدنية بشكلها التقليدي عاجزة عن استيعابها أو إيجاد حلول عادلة لها، مما يستلزم تطويع النظام القانوني للمسئولية المدنية بحيث يتلامم والطبيعة الخاصة للضرر البيئي، وكذا تطوير ذلك النظام بحيث لا يقف عند حد علاج الأضرار البيئية بعد حدوثها، بل الحد من الأضرار والأخطار التي تصيب البيئة، والعمل على منعها ومكافحتها والوقاية من التعدي على البيئة، وهذا التطوير يجب أن يمتد إلى الأساس القانوني للمسئولية المدنية عن الإضرار بالبيئة، وقد تم بحث هذا الموضوع في هذه الرسالة في ثلاثة أبواب يسبقها فصل تمهيدي.
