الإنسان هو أعلى ما خلق الله عز وجل في هذا الكون حيث كرمه فجعل له من الحقوق والمصالح ما يكفل له كرامته ويحقق له سيادته على سائر المخلوقات ومن هذه الحقوق التي كفلتها الشريعة الإسلامية والقوانين الوضعية حقه في البقاء النوعي والتناسل وسلامة الجسد وحقه في الكرامة الإنسانية وحقه في سلامة عرضه وحقه في أن يعيش في امن وأمان لذا اخترت هذا الموضوع وكان بعنوان عقد إجارة وزرع الأعضاء البشرية وما يترتب عليه من آثار في القانون المدني تناولت فيه التعريف بموضوع البحث وأسباب اختياري لهذا الموضوع والتساؤلات حوله ومنهجه واعتمدت فيه على المنهج التحليلي لنصوص القانون المدني في نص المادة ٥٥٨ من القانون المدني المصري وكذا قانون نقل وزرع الأعضاء البشرية القانون رقم لسنة ۲۰۱۰ مع الإشارة إلى موقفي القانون الفرنسي والفقه الإسلامي

Human being is the most elevated one, who has been created by the Lofty Allah, (God) in this universe, as He honored him and made for him some rights He realizes for him his sovereignty on the various kinds of creations. From among these rights his right of safety for his honor and his right to live in safety and peace, therefore I have chosen this subject, which was titled "A rental contract and the cultivation of the Human organs, and what might be based upon it of the effects in the civil law, in which I have dealt with the definition with the subject of the research and the reasons of my selecting to this subject, and the questions raised about it and its methodology and the I have relied upon the analytical methodology for the civil law texts in the stipulation of the article number 558 from the Egyptian Civil Law, and also the law of the transfusion and the cultivation of the Human organs which is the law number 5 for the year 2010 in addition to the reference to the two stands of the French Law and the Islamic jurisprudence.
