تتناول هذه الدراسة صياغة العقود الإدارية الدولية وتطورها، ويقصد بالصياغة بشكل عام التنظيم الجيد لإبراز المضمون، ومن ثم يشمل مصطلح الصياغة عنصرين رئيسين هما الشكل والمضمون، وكل منهما يكمل الآخر، فبدون التنظيم الجيد لن يكون من السهل فهم المضمون، وبدون المضمون الجيد، لن تكون فائدة
من التنظيم.
وتهدف هذه الدراسة في المقام الأول إلى محاولة وضع منهاج علمي لصياغة العقود الإدارية الدولية والإفادة من الجذور التاريخية لها، ويقصد بالمنهج العلمي استخدام أساليب ثابتة بشكل متكرر تقوم على مبادئ محددة للتوصل إلى النتيجة نفسها، ويعني ذلك التنبؤ بالنتيجة إذا استخدمت الأساليب نفسها، وتطبيقاً على صياغة العقود، يعني ذلك ببساطة وضع نظام ثابت لهذه الصياغة، وبدلاً من الاعتماد على الأنموذجات الجاهزة للعقود والتي لا تصلح حتماً لكل الأغراض، أو صياغة العقد اعتمادا على الخبرة العلمية والمهارة مما يؤدي إلى المخاطرة بتكبد خسائر كبيرة للدول النفطية عند إبرامها للعقود النفطية المهمة مع الشركات النفطية الكبيرة في مجال البحث والتنقيب وإنتاج النفط، فالحل السليم يكمن في الاعتماد على طريقة ثابتة لصنع العقد تناسب كل غرض على حدة، أياً كان وتقوم على إتباع منهج
يضمن التوصل إلى نتائج حاسمة.

This study deals with the drafting of international administrative contracts and its development. Drafting means wording in general organization good to highlight the content, and then include the wording of the term of two main form and content, each complements the other. Without good organization it will not be easy to understand content, and without good content, will not be useful of regulation.
This study aims, in the first place, to try to set a scientific approach to the formulation of international administrative contracts and take advantage of its historical roots, and by scientific method we mean to use static methods that are frequently based on specific principles to achieve the same result, and means to predict the result if you use the same methods, and apply them to formulate contracts that simply means putting a fixed system of this language, and instead of relying on Ready models promises which are not suitable inevitably all purposes or drafting of the contract depending on the scientific expertise and skill which leads to risk incurring the oil countries big losses when concluded important oil contracts with major oil companies in field research and exploration and production of oil. Proper solution lies on that having to rely on a steady way to make all fit the purpose of the unit, and whatever is to
follow the approach ensures to reach conclusive results.
