تم تناول موضوع هذه الرسالة باشتمالها للجريمة التأديبية وعلاقتها بالجريمة الجنائية ثم إجراءات التأديب الإدارى للموظف العام وأثر الحكم الجنائى أمام سلطات تأديب الموظف العام . واتضح أن التأديب الرئاسى والتأديب شبه القضائى يمثلان نظاما واحدا فى التأديب وهو النظام الإدارى . وهذا النظام بصورتيه أصبح يوفر ضمانات للموظف العام تقترب من ضمانات النظام القضائى فى التأديب . مما يحقق الفعلية المرجوة من التأديب ويحقق الضمان للموظف العام على حد سواء
This study is about the semi judicial and the presidential discipline systems as they represent unified disciplinary system. This system has provided guarantees for the public servant closer to the judicial discipline guarantees. This system provides effectiveness and guarantees at the same time.
Discipline system is greatly affected by the criminal process during the discipline process of the public servant. Therefore, the crimes committed by public servants provided in penal Law represent real interference between in these two systems.
This interference led to limited effect of the criminal process on the discipline system. This is evident in the persuasion of the criminal decisions which in front of the discipline authority is limited in convection to the verification of the act and it's principal. Where as the persuasion of the acquittal decisions are limited to deny the act or its principal.
