تختص المحكمة الجنائية الدولية حاليا بنظر ثلاث من أخطر الجرائم الدولية و هي: جريمة الإباده الجماعية: جرائم ضد الإنسانية و جرائم الحرب. فإذا ما وقعت جريمة أو أكثر من هذه الجرائم و عجز القضاء الوطني أو رفض التحقيق فيها و ملاحقة مرتكبوها: يتولي المدعي العام للمحكمة الجنائية الدولية مهمة التحقيق فيها من تلقاء نفسه أو من خلال الإحالة من الدول أو من مجلس الأمن: بعد الحصول على إذن الدائرة التمهيدية لبدء التحقيق: كونها تشارك المدعي العام إجراءات التحقيق في هذه الجرائم

International criminal court has the jurisdiction to investigate in three serious crimes i.e. genocide, crimes against humanity and war crimes.
When one crime is committed and the national court rejected to trial in it, the general attorney in the International criminal Court has to investigate by himself or by retirement from the concerned state to the jurisdiction of the ICC or the retirement could be from the Security Council. After the permission of the preliminary circuit, the general attorney has to start investigation at once in the crime.
During trial procedures, the general attorney has to consider the rights of the suspect or the criminal who commits a crime in the court's jurisdiction according to the international treaties of human rights
