يعد تأمين البطالة نظامًا معقدًا نظرًا للمشاكل العديدة الناجمة عن تطبيقه حيث تختلف سياسات الدول في توطيده من دولة لأخرى وفقًا لقدراتها الفنية والإدارية والاقتصادية. <br/>كما يعتبر هذا التأمين من أصعب أنواع التأمينات الاجتماعية من حيث الرقابة والتمويل بسبب التلاعب وادعاء البطالة، فضلا عن كثرة العاطلين عن العمل أثناء الأزمات الاقتصادية التي يصعب تحديد آثارها مسبقا، مما يجعل التمويل اللازم لهذا النوع غير دقيق. <br/>وعلى الرغم من ذلك أصبح تأمين البطالة عن هدفًا أساسيًا لكل دولة بما في ذلك مصر -تسعى إلى الاستقرار السياسي والاجتماعي والاقتصادي داخل البلاد، ومن ثم تحاول كل الدولة ترسيخه حسب قدرتها الاقتصادية، بحيث تضيق وتسع مزاياه وفقًا لعوامل متعددة، مثل العوامل الفنية والإدارية والاقتصادية وغيرها . وقد نظمت مصر هذا التأمين من خلال قانون التأمينات الاجتماعية والمعاشات رقم ١٤٨ لسنة ۲۰۱۹ ، حيث يتضمن حماية المؤمن عليهم في القطاعين العام والخاص دون القطاع الحكومي. ومن ثم كان الهدف من هذه الدراسة عرض رؤية من واقع الحياة العملية حتى يمكن المشرع المصري من الاستعانة بها لإمكانية بسط الحماية لكافة العاملين بما فيهم العاملين في الجهاز الإداري للدولة والعمال المؤقتين والموسميين وغيرهم. |

Unemployment insurance is a complex system due to the many problems resulting from its application, as the policies of countries in consolidating it differ from one country to another according to their technical, administrative and economic capabilities. This insurance is also considered one of the most difficult types of social insurance in terms of control and financing due to manipulation and claiming un-employment, as well as the large number of unemployed during eco-nomic crises whose effects are difficult to determine in advance, which makes the necessary financing for this type inaccurate. Despite this, unemployment insurance has become a primary goal for all A state - including Egypt - seeks political, social and economic stability within the country, and then each state tries to consolidate it according to its economic capacity, so that it narrows and expands its advantages according to multiple factors, such as technical, administrative, eco-nomic and other factors. Egypt has regulated this insurance through the Social Insurance and Pensions Law No. 148 of 2019, which in-cludes the protection of the insured in the public and private sectors but not the government sector. Hence, the aim of this study was to present a vision from the reality of practical life so that the Egyptian legislator can use it for the possibility of extending protection to all workers, including workers in the administrative apparatus of the State, temporary and seasonal workers and others. |
