| Summary, etc. | استهدفت الدراسة تحديد إطار واضح ومحدد لاستخدام تقنية الاتصال عن بعد في الإجراءات الجزائية وفقاً لأحكام قانون الإجراءات الجزائية الاتحادي رقم (۳۸) لسنة ۲۰۲۲ م - الباب الخامس - في شأن استخدام تقنية الاتصال عن بعد في الإجراءات الجزائية والتشريعات المقارنة، فالتطور السريع في تقنية الاتصال عن بعد قد انعكس بدوره على إجراءات التقاضي، حيث أصبحت تتم هذه الإجراءات بطريقة إلكترونية، وهو ما عرف بالتقاضي الإلكتروني أو التقاضي عن بعد، والذي يعتبر أهم تطبيقات التطور العلمي والتقني في مجال العدالة على اعتبار أن تطبيق التقنية بالشكل الصحيح والتدريجي في هذا المجال له أثر إيجابي لا محال، ويشمل هذا الأثر سرعة إنجاز المعاملات وتوحيد وتبسيط إجراءات التقاضي والمساهمة في أمن المعلومات بحفظها وإتاحة الاطلاع عليها للمصرح لهم إضافة إلى ضمان جودة العمل ومواكبة التطور . <br/>واعتمد الباحث على استخدام المنهج التحليلي بصورة عامة، وذلك من خلال تحليل القواعد القانونية الواردة في قانون الإجراءات الجزائية رقم (۳۸) لسنة ۲۰۲۲م وبيان مدى ملائمة تطبيقه في النظام الإلكتروني للتقاضي ومن ثم مقارنتها في ضوء الاتجاهات والمفاهيم للتشريعات التي تبنت الأسلوب الإلكتروني للتقاضي بالعرض والتحليل والتقييم بهدف الوصول إلى المسائل الشكلية التي تندرج ضمن نطاقها، كما اتبع الباحث المنهج العلمي المقارن على مستويات متعددة ومن ضمنها عقد المقارنات بين القواعد العامة للتقاضي الجزائي والأحكام الخاصة بالتقاضي الإلكتروني على المستويين المحلي والدولي، وختمت الدراسة بنتائج وتوصيات. |

| Summary, etc. | The study aimed to define a clear and specific framework for the use of remote communication technology in criminal proceedings in accordance with the provisions of the Federal Criminal Procedure Law No. (38) of 2022 AD - Chapter Five regarding the use of remote communication technology in criminal proceedings and comparative legislation. The rapid development in remote communication technology has in turn been reflected in litigation procedures, as these procedures are now conducted electronically, which is known as electronic litigation or remote litigation, which is considered the most important application of scientific and technical development in the field of justice, given that the correct and gradual application of technology in this field has an inevitably positive impact. This impact includes the speed of completing transactions, unifying and simplifying litigation procedures, and contributing to information security by preserving it and making it available to those authorized, in addition to ensuring the quality of work and keeping pace with development. <br/>The researcher relied on using the analytical approach in general, by analyzing the legal rules contained in the Criminal Procedure Law No. (38) of 2022 AD and stating the extent of its suitability for application in the electronic litigation system and then comparing it in light of the trends and concepts of the legislation that adopted the electronic method of litigation by presentation, analysis and evaluation with the aim of reaching the formal issues that fall within its scope. The researcher also followed the comparative scientific approach at multiple levels, including making comparisons between the general rules of criminal litigation and the provisions specific to electronic litigation at the local and international levels.
