| Summary, etc. | الجرائم الجمركية تعتبر من أخطر المشاكل التي تواجهها المجتمعات البشرية فهي إحدى الجرائم الاقتصادية التي تمس أمن الدولة الاقتصادي وتخالف السياسية الاقتصادية التي تضعها الدولة حيث أنها تعيق التقدم في كافة المجالات، ومن المعروف أن للرسوم الجمركية أهمية كبيرة في رفد خزانة الدولة بالأموال فسلبيات هذه الجريمة وأضرارها تشمل المجتمع بأسره، <br/>وبالتالي تلجأ الدول إلى مكافحتها والمعاقبة عليها حيث أصبحت ضرورية وهو حق للدولة ومن معطيات سلطتها القانونية وجوهر وجودها بغية دفع الاعتداء على النظام الاجتماعي القائم، وخاصة بعد التطور الذي حصل في الميادين الاقتصادية والسياسية والاجتماعية للدولة في العصر الحديث، عليه لا يختلف الأمر في جمهورية مصر ودولة الإمارات عن بقية الدول الأخرى في تعرض تجارتهما الخارجية لهذا النشاط الإجرامي، وبغية النهوض بالسياسة الاقتصادية والاجتماعية والأمنية والصحية والزراعية وغيرها، وتأمين فاعليتها لتفادي النتائج السلبية التي تتركها هذه الآفة التي تمثل صورة من صور الخروج على السياسة التجارية وأدواتها المختلفة، لكن يبقى السؤال عن مدى فاعلية وكفاية التشريعات الجمركية في كلا البلدين الخاصة بأحكام الجرائم الجمركية لذلك كان لابد من دراسة هذه التشريعات للوقوف على مدى قدرتها على السيطرة على مثل هذا النوع من الجرائم. |

| Summary, etc. | Customs crimes are considered one of the most dangerous problems facing human societies. They are one of the economic crimes that affect the economic security of the state and violate the economic policy set by the state, as they hinder progress in all fields. It is known that customs duties are of great importance in supplying the state treasury with money. <br/>The negatives and harms of this crime include the entire society. <br/>Therefore, countries resort to combating and punishing them as they have become necessary and are a right of the state and a given of its legal authority and the essence of its existence in order to prevent attacks on the existing social system, especially after the development that has occurred in the economic, political and social fields of the state in the modern era. <br/>Accordingly, the matter in the Arab Republic of Egypt and the United Arab Emirates is no different from other countries in their foreign trade being exposed to this criminal activity, and in order to advance the economic, social, security, health, agricultural and other policies, and ensure their effectiveness to avoid the negative consequences left by this scourge, which represents a form of deviation from the trade policy and its various tools. |
