| Summary, etc. | على الرغم من أن قانون مجلس الدولة رقم ٤٧ لسنة ۱۹۷۲ ينص في مادته العاشرة على اختصاصه بنظر كافة المنازعات الإدارية ، إلا أن هناك قيودًا على ولاية محاكم القضاء الإداري عند نظره منازعات الاستثمار، ومن ذلك أعمال السيادة، قيود الاختصاص الولائي، وكذلك اتفاقات التحكيم. ولعل من أهم المشكلات العملية التي تواجه المستثمرون في منازعاتهم بشأن الاستثمار هي عدم وضوح حدود الاختصاص وتداخلها بين قضاء مجلس الدولة وهيئات التحكيم وهو ما يؤدي بالضرورة إلى تداخل وتعارض أحكامهما وتشابكهما بصورة يتعذر معها ترجيح الجهة صاحبة الاختصاص والحكم الواجب التنفيذ. فالتحكيم كطريق استثنائي بديل، لا يغني عن الاحتكاك بالقضاء الإداري في منازعات الاستثمار وذلك في حال التعرض المشروعية قرار إداري صادر عن الجهة الإدارية بالدولة ومؤثر في تنفيذ المشروع الاستثماري محل التحكيم فضلاً عن الالتجاء للقضاء بشكل عام في مرحلة ما بعد صدور حكم التحكيم سواء بإقامة دعوى البطلان او عند المنازعة في تنفيذه. <br/>وعليه، فقد تطرقنا بداية لبيان المقصود بمفهوم الاستثمار في القانون الداخلي والقانون الدولي، فضلا عن بيان صور المنازعات الاستثمارية وتحديد مضمونها ، ثم تعرضنا إلى بحث نطاق اختصاص القضاء الإداري بنظر منازعات الاستثمار الوطنية والدولية، وكذلك، أثر القضاء الإداري على التحكيم في منازعات الاستثمار من حيث اختصاصه في منازعات تنفيذ حكم التحكيم، وأوردنا كذلك بعض صور للتنازع بين القضاءين ووسائل فضه. <br/>ومن ثم، فإن تداخل الاختصاص بين قضاء مجلس الدولة وهيئات التحكيم يرجع إلى غياب النصوص التشريعية الوطنية أو الدولية - الحاكمة بشكل قاطع لتلك المسألة، حيث تسعى كل جهة لوضع بند اختصاص عام، وتفسيره تفسيرًا موسعًا لتوسيع نطاق اختصاصها دون تحديد حدود تلك الرقابة أو ذلك الاختصاص، وهو ما يخل بمصالح الأطراف المتنازعة، ويتمسك كل صاحب مصلحة بالجهة التي تخدم مصلحته بشكل أكبر ، سواء تمثل ذلك في القضاء الإداري أو هيئات التحكيم. |

| Summary, etc. | Although the State Council Law No. 47 of 1972 stipulates in its tenth article that it has jurisdiction to hear all administrative disputes, we can find that there are restrictions on the jurisdiction of the administrative judiciary courts when hearing investment disputes, including acts of sovereignty, restrictions on jurisdictional jurisdiction, as well as arbitration agreements. Feasibly one of the most important practical problems facing investors in their investment disputes is the lack of clarity of jurisdictional limits and the overlapping between the state council and arbitration tribunals, which necessarily leads to conflicting rulings and their involvement, in a way that makes it difficult to give preference to the party with jurisdiction and the enforceable ruling. Since arbitration, as an exceptional alternative method, does not replace the necessity of administrative judiciary in investment disputes, in the event of exposure to the legitimacy of an administrative decision issued by the administrative body in the state and affecting the execution of the investment project subject to arbitration, in addition to resorting to the judiciary in general after the issuance of the arbitration award, whether by filing a lawsuit for nullity or when executing it. <br/>Accordingly, we initially addressed the meaning of the investment in both domestic and international law and explained the forms of investment disputes. Then we discussed the scope of the jurisdiction of the administrative judiciary in considering national and international investment disputes, as well as the effect of the administrative judiciary on the arbitration of investment disputes regarding its jurisdiction on disputes of enforcing the arbitration award, we also mentioned some examples of conflicts between the two judiciaries and the means of resolving them. <br/>Therefore, the overlap of jurisdiction between the State Council and arbitration tribunals is due to the absence of legislative provisions - national or international - that decisively govern this issue, as each body seeks to establish a general jurisdiction clause and interpret it in a broad interpretation to expand the scope of its jurisdiction without specifying its limits, which prejudices the interests of the disputing parties, and each interested party adheres to the entity that serves his interest more, whether that is represented by the administrative judiciary or arbitration tribunals. |
