لقد تمحورت هذه الأطروحة الموسومة بمضمون العقد بين النزعة الشخصية والموضوعية حول معالجة إشكالية معينة يواجهها أفراد المجتمع عند قيامهم بتنفيذ العقود التي أبرموها في إطار المعاملات المالية. وهذه الإشكالية تكمن في عدم معرفة هؤلاء الأفراد المتعاقدين لمضمون عقودهم أي بحقوقهم والتزاماتهم بشكل صحيح، ففي الغالب الأعم يقوم هؤلاء الأفراد بإبرام عقودهم دون أن يضمنونها بالتفصيلات المتعلقة بتنفيذها بشكل صحيح، لذلك نصت القاعدة العامة المتعلقة بتنفيذ العقود وفقا للمواد ۱۴۸ مدني مصري و ٢٤٦ معاملات مدنية إماراتي و ۱۱۰٤ مدني فرنسي على أنه يجب تنفيذ العقود بحسن نية. وقد تمت المعالجة لإشكالية البحث من أجل التوصل إلى أهداف معينة تتمثل في محاولة إيجاد حلول للقضاء أو التخفيف من هذه الإشكالية التي تؤرق بال المجتمع. وقد انحصر نطاق المعالجة في إطار القانون المدني المصري الصادر بالقانون رقم ١٣١ لسنة ١٩٤٨ والتقنين المدني الفرنسي المعدل بالمرسوم رقم ۱۳۱ - ۲۰۱٦ بشأن تعديل قانون العقود والأحكام العامة للالتزامات والإثبات المنشور بالجريدة الرسمية بتاريخ ۱۱-۰۲ - ۲۰۱٦ من جهة. وبين قانون المعاملات المدنية الاماراتي الصادر بالقانون رقم 5 لسنة ۱۹۸۵ والمعدل بموجب المرسوم اتحادي رقم 30 لسنة ۲۰۲۰ والشريعة الإسلامية التي هي أساس هذا القانون من جهة أخرى. وقد تم التوصل من خلال هذه المعالجة التي أتبع فيها المنهج التحليلي والمنهج المقارن إلى حلول معينة لهذه الإشكالية. |

This thesis, called the content of the contract between personalism and objectivity, revolved around addressing a specific problem that members of society face when they implement the contracts they have concluded within the framework of financial transactions. This problem lies in the lack of knowledge of these contracting individuals about the content of their contracts, that is, their rights and obligations correctly. In most cases, these individuals conclude their contracts without including them with details related to their correct implementation, so the general rule regarding the implementation of contracts in accordance with Articles 148 Egyptian Civil, 246 Emirati Civil Transactions, and 1104 French Civil stipulates that contracts must be implemented in good faith. The research problem was addressed in order to reach specific goals, namely trying to find solutions to eliminate or alleviate this problem that is troubling society. The scope of treatment was limited to the framework of the Egyptian Civil Code promulgated by Law No. 131 of 1948 and the French Civil Codification amended by Decree No. 131-2016 amending the Contract Law and the General Provisions of Obligations and Evidence published in the Official Gazette on 02-11-2016 on the one hand. And between the UAE Civil Transactions Law issued by Law No. 5 of 1985 and amended by Federal Decree No. 30 of 2020, and Islamic Sharia, which is the basis of this law, on the other hand. Through this treatment, in which I follow the analytical and comparative approaches, certain solutions to this problem have been reached |
