تناولت الدراسة تقييد حرية التعبير عن الرأي بقيود جنائية؛ ولأهمية حرية التعبير وخطورة القيد الجنائي؛ إتبعت المنهج المقارن لبيان الحماية المقررة لحق التعبير علي المستوي الدولي والمصري. وتبين إرتقاء حرية التعبير لمصاف الحقوق الأساسية وكفالتها بالمواثيق والإتفاقيات الدولية ودساتير أغلب الدول. <br/>وأولاها النظام المصري حماية مباشرة، وغير مباشرة بضمانة الحقوق المرتبطة بها كالإعتقاد والوصول للمعلومات وممارسة الحقوق السياسية والنشر ، وتأكد بالسوابق القضائية. ولم يُنكر أحدًا قابليتها للتقييد للأمن القومي والنظام العام والصحة العامة والخصوصية والحق في السمعة، وجرم المشرع المصري والفرنسي الرأي حال التعدي عليها. وأوجبت المواثيق أن يكون القيد ضروري ويناسب المصلحة المحمية في ظل الشرعية الجنائية. وبحثت الدراسة النموذج القانوني لجريمة الرأي ؛ ويلزم لتوافره سلوك تعبيري بأيا من طرق التعبير بأحد صور العلانية التي يجوز القياس فيهما ، وقصد جنائي عام. وأسهم تطور وسائل الإعلام بوفرة سبل العلانية؛ وأثر في تحديد أنظمة المسئولية الجنائية تخالف المبادئ العامة أحيانًا. ويعد النقد والإبلاغ عن الجرائم والدفاع أمام المحاكم والأداء البرلماني صورًا لإستعمال الحق وسببًا للإباحة في جرائم الرأي. وخص المشرع الجنائي المصري والفرنسي أحيانًا جرائم الرأي بقواعد إجرائية تخالف قواعد الإختصاص القضائي العامة ومبدأ الأصل في الإنسان البراءة واللجوء للقاضي الطبيعي، وتبين حاجة الإنترنت لتنظيم خاص يناسب طبيعته. والحاجة لقانون ينظم الرأي والتعبير. وأنتهت لتوصيات لحل الإشكاليات التي أثارتها. |

The study dealt with restricting freedom of expression of opinion through criminal restrictions. Given the importance of freedom of expression and the seriousness of criminal register, it followed the comparative method to demonstrate the established protection of the right of expression at the international and Egyptian levels. It shows that freedom of expression is elevated to the level of basic rights and is guaranteed by international charters, agreements, and the constitutions of most countries. The Egyptian regime prioritized direct and indirect protection by guaranteeing the rights associated with it, such as belief, access to information, and the exercise of political and publishing rights, and this was confirmed by judicial precedents. No one denied its ability to restrict national security, public order, public health, privacy, and the right to reputation, both Egyptian and French legislators criminalized opinion if it was violated. The charters require that the restriction be necessary and appropriate to the interest protected under criminal law. The study examined the legal model of opinion crime. It is necessary for it to have expressive behavior in any of the ways of expression, in one of the forms of publicity in which it is permissible to compare them, and general criminal intent. The development of the media contributed to the abundance of ways of publicity. The effect of determining criminal liability systems sometimes violates general principles. Criticism, reporting crimes, defense before the courts and parliamentary performance are forms of exercising the right and a reason for the permissibility of crimes of opinion. The Egyptian and French criminal legislators sometimes singled out crimes of conscience with procedural rules that deviate from the general judicial jurisdiction rules and the principle of the presumption of innocence, in humans, and recourse to a natural judge, and demonstrate the Internet's need for a special regulation that suits its nature and the need for a law regulating opinion and expression. It concluded with recommendations to solve the problems it raised |
