| Summary, etc. | هذه دراسة تأصيلية مقارنة تدور فيها إشكالية البحث حول موقف التشريعات المختلفة من مساءلة الشخص المعنوي جنائيا في المجال الطبي، ومن أبرز ما انتهت إليه الدراسة أنه لدى إسناد الركن المادي للجريمة إلى الشخص المعنوي ينبغي الاعتداد بكل من معايير - المصلحة والنيابة والاختصاص - مستقلا، مع جعل إسناد الركن المعنوي منضبطاً لا يتعدى المعايير الأخلاقية للوم إلا بالقدر الذي تفرضه المنفعة الاجتماعية، ويعتبر معيار الوعي بالنتيجة بمثابة معيار أصلي لتجريم الخطأ غير العمدي، بينما يعتبر الاهمال الجسيم بمثابة معيار احتياطي لتجريم ذلك الخطأ، كما تجدر الاستفادة من ثراء مفهوم تعريض الغير للخطر عمدًا، لاسيما عبر استثماره في تنقيح الركن المعنوي للجريمة، كما تبين أننا في حاجة لتجريم الامتناع عن تقديم مساعدة لشخص في خطر. |

| Summary, etc. | This is a comparative study in which the research problem revolves around the position of different legislations on the criminal liability of legal persons in the medical field. One of the most prominent findings of the study is that when attributing the material element of the crime to a legal person, each of the criteria; interest, representation and competence, should be taken into account independently, while making the attribution of the moral element disciplined and not exceeding the ethical standards of blame except to the extent imposed by the social benefit. The criterion of awareness of the result is considered an original criterion for criminalizing unintentional error, while gross negligence is considered a reserve criterion for criminalizing that error. It is also worth taking advantage of the richness of the concept of intentionally exposing others to danger, especially by investing it in refining the moral element of the crime. It also shows that we need to criminalize the failure to provide assistance to a person in danger |
