جريمة التنمر إحدى الجرائم القديمة بمضمونها، وإن كانت حديثة باسمها. يختلط مفهوم التنمر مع عدد من الجرائم الأخرى كالبلطجة، والإيذاء الخفيف، والضرب والجرح، والسب والقذف. إلا أن النص التجريمي للتنمر يتميز بمرونة تسمح باستيعاب العديد من السلوكيات الإجرامية التي قد تكون مؤثمة بموجب نصوص تجريمية أخرى. <br/>تتمثل أساليب التنمر في عدة أشكال، منها التنمر اللفظي والجسدي، والجنسي، والعنصري والاجتماعي. ويحدث التنمر في أي مكان يتفاعل فيه البشر، غير أنه يكثر بين طلاب المدارس والجامعات، وفي بيئة العمل. <br/>ومن أبرز خصائص جريمة التنمر أنها جريمة عمدية بسيطة وقتية، وتعد من جرائم الخطر الواقعي، كما أنها من الجرائم ذات الأثر النفسي البالغ. تمثل أفعال التنمر انتهاكا صارخا لحقوق الإنسان الأساسية، خاصة الحق في الكرامة والسمعة، والاعتبار، والخصوصية. وهذه الحقوق تستوجب الحماية من خلال أدوات قانونية صارمة وفعالة. <br/>يقوم البنيان القانوني لجريمة التنمر على ركنين أساسيين الركن المادي والركن المعنوي. وقد كشفت الدراسة عن طبيعة هذه الجريمة في التشريعات المقارنة كالتشريع المصري والفرنسي والأنجلو - أمريكي. ففي التشريع المصري، تعد جريمة التنمر من جرائم السلوك بينما تعد في بعض التشريعات الأخرى من الجرائم ذات النتيجة، كالتشريع الفرنسي وبعض التشريعات الأنجلو - أمريكية. <br/>أما من حيث الركن المعنوي، فإن التنمر جريمة عمدية تتطلب قصدًا جنائيا عاما، بالإضافة إلى قصد خاص يتمثل في نية الإيذاء. كما أن التنمر قد يكون مباحًا في بعض الأحيان، ويخضع لأسباب الإباحة وموانع المسؤولية الجنائية. <br/>على صعيد العقوبة، تباينت التشريعات المقارنة بين التخفيف والتشديد. فقد نصت التشريعات المصرية، والفرنسية، والأنجلو - أمريكية، على فرض عقوبات متنوعة ومتدرجة بشأن جريمة التنمر . ففي حالة ارتكاب الجريمة دون توافر ظروف مشددة، تكون العقوبة وفقا للنص القانوني في صورتها البسيطة. أما إذا توافرت ظروف مشددة، يتم تشديد العقوبة وفقا لما يقتضيه الظرف من أحكام. |

The concept of bullying overlaps with various other crimes, such as thuggery, minor injury, assault, battery, defamation, and slander. However, the legal provision for bullying is distinct in its flexibility, allowing it to encompass a variety of criminal behaviors that may also be punished under other legal texts. <br/>Bullying manifests in several forms, including verbal, physical, sexual, racial, and social bullying. It can occur in any setting where individuals interact, though it is most common in schools, universities, and workplaces. A key characteristic of bullying is that it is an intentional, simple, and momentary crime, categorized as a real danger crime, and it often has a significant psychological impact. Bullying actions are a clear violation of fundamental human rights, particularly the right to dignity, reputation, respect, and privacy. These rights require protection through stringent and effective legal tools. <br/>The legal framework for the crime of bullying rests on two essential elements: the material element and the mental element. The research highlights the nature of this crime in comparative legislations, such as Egyptian, French, and Anglo-American laws. In Egyptian law, bullying is classified as a crime of conduct, whereas in some other legal systems, such as French and Anglo-American laws, it is treated as a result-based crime. In terms of the mental element, bullying is an intentional crime that requires a general criminal intent, along with a specific intent to cause harm. Additionally, bullying can sometimes be justified under certain defenses or exceptions to criminal liability. <br/>Regarding punishment, comparative legislations vary between leniency and severity. Egyptian, French, and Anglo-American laws prescribe various and graduated penalties for bullying. If the crime is committed without aggravating circumstances, the punishment is as specified in the relevant legal text in its basic form. However, if aggravating circumstances exist, the punishment is intensified according to the nature of the circumstances. |
