| Summary, etc. | لقد تطورت التشريعات المنظمة لتسجيل الملكية العقارية، وتطورت الجهات التي عهد عليها بهذا التسجيل، وهو ما ترتب عليه امكانية وجود أكثر من محرّر مشهر كل منها في جهة من الجهات التي عهد إليها بالتسجيل. <br/>وبالتالي أصبح هناك حاجة ملحة لمعالجة هذه الاشكالية، وذلك بتحديد أحكام منظمة لكيفية المفاضلة بين المحررات المشهرة بعضها البعض. <br/>هذا وقد تناولت هذه الدراسة النظم القانونية المختلفة للشهر العقاري وتناولها فيها نظام الشهر الشخصي تناولت كذلك تنظيم إجراءات الشهر في المجتمعات العمرانية الجديدة. <br/>ثُمَّ تناولنا بعد ذلك إجراءات شهر أسباب كسب الملكية العقارية الخاصة وتناولنا فيها الأحكام واجبة الشهر والعقود واجبة الشهر . <br/>وقد تناولت الرسالة وسائل حماية الملكية العقارية، ثم تناولنا الترجيح والمفاضلة بين المحررات المشهرة وتناولنا فيها الترجيح عند صدور التصرف في العقار من ذات الشخص لمشترين متعاقبين زمانيا. <br/>وتناولنا كذلك حالة التصرف في العقار محل المفاضلة من متصرفين مختلفين. <br/>وتناولت الرسالة كيفية إعمال أحكام المفاضلة، وأهتمت بأثر حسن النية في عملية التسجيل ومتى يؤثر حسن النية في عملية التسجيل وأثر ذلك في إعمال قواعد المفاضلة. <br/>كما تناولت الرسالة الأثر الرجعي للملكي وكيفية اتفاق إعمال أحكام الأثر الرجعي للملكية مع القواعد العامة وإعمالها. <br/>وأخيرا تناولت الرسالة أحكام المسئولية المدنية عن أحكام العاملون بأعمال المفاضلة وكيفية تعويض المضرور عنها وطبيعة التعويض وأحكامه. <br/>وتناولت في إعداد الرسالة المنهج التحليلي الذي لا يقتصر على وصف الظاهرة بل يتعداها إلى التحليل، كما اتبع المنهج التطبيقي وذلك بالربط بين الدراسة التحليلية والتطبيق العملي. |

| Summary, etc. | A Study of Ranking and Protecting Ownership In the field of registering real rights, there is often competition and contradiction between title deeds. <br/>As real estate registration laws and competent authorities have evolved, it has become possible for more than one document to be registered, each with a different registration authority. <br/>This has led to the need for solutions to address these problems, particularly in developing rules for ranking publicized documents. <br/>This study examines the different legal systems of real estate registration, including personal real estate publication and the new urban publication system. <br/>It also discusses the procedures for publicizing the causes for acquisition of private property ownership, such as mandatory registration of judicial decisions and contracts. <br/>The thesis also addresses means of protecting real estate ownership including the ranking and judging of publicized documents. <br/>This includes considering the most acceptable transaction in cases where property is transferred from one person to several persons in chronological sequence. <br/>We also addressed the case of disposing of a property, which is subject to ranking, from different disposers. <br/>Additionally, the thesis highlights the rules for applying ranking, particularly the importance of bona fide contributions to the registration process and how they affect the ranking process. <br/>The retroactive effect of ownership is also addressed, including how the implementation of this provision is consistent with general rules and their implementation |
