| Summary, etc. | تعد الشركات التجارية هي الصورة المثالية لممارسة مختلف الأنشطة التجارية، ونادراً ما يمارس هذا النشاط بشكل فردي، وحتى في هذه الحالات، يتم فصل الوضع المالي للشخص عن الوضع المالي للشركة، في حالة إنشاء شركة تسمى شركة الشخص الواحد . وقد نمت الشركات التجارية بشكل كبير، وامتدت إلى جميع جوانب الحياة، وزادت، سواء من حيث عددها أو من حيث القيمة المالية التي تمثلها. وهناك شركات يتجاوز رأس مالها مليارات الدولارات <br/>ولا شك أن الشركة، سواء في مرحلة التأسيس، أو في مرحلة الحياة المهنية، أثناء ممارسة نشاطها ، أو عند انتهاء صلاحيتها بالتصفية، على سبيل المثال، يمكن أن تقع في هاوية الجريمة، بسبب انخراط ممثليها في أنشطة غير مشروعة . <br/>ومن الصعب للغاية ترك هذه الأنشطة دون تجريم وعقاب، بل من غير الممكن ترك هذه الأنشطة للقواعد العامة في قانون العقوبات، حيث قد تكون هذه القواعد غير كافية لمواجهة هذه الأنشطة الإجرامية علاوة على ذلك، فإن هذه القاعدة العامة للتجريم والعقاب تواجه الأفعال الفردية، كقاعدة عامة . ولا يجوز أن تخضع <br/>طبيعة الشركات، وقواعد إنشائها، ونشاطها، وتصفيتها، وانقضائها بوجه عام للقواعد العامة للتجريم والعقاب الواردة في المواد العامة والخاصة من قانون العقوبات. |
