In the last century, the world has witnessed a massive technological development accompanied by a high demand for the insurance operations due to various risks developed by such development. in spite of the clear variance of the economic systems of the world countries conducting insurance operations, the principles and bases on which these operations are based are the same in all countries. Insurance is a technical operation aiming at pooling the risks and distributing the losses among the parties exposed to these risks. Therefore, this study seeks to investigate the legal system of the international insurance contracts through specifying what the international insurance contract is, its characteristics, and the law applicable to the conclusion of the international insurance contract as for the formal and substantive conditions, showing the law applicable to the topic of the international insurance contract. then, it specifies the judicial jurisdiction over the disputes of the international insurance contract through specifying the standards of judicial jurisdiction, and finally the court that is competent to hear the dispute. |

لقد صاحب التطور التكنولوجي الهائل الذي شهده العالم منذ القرن الماضي إقبالًا شديداً على عمليات التامين ؛ نظراً للمخاطر المتنوعة التى جلبها هذا التطور. ورغم التباين الواضح للنظم الاقتصادية لدول العالم التي تتم فيها عمليات التأمين، إلا أن المبادىء والأسس التي تقوم عليها هذه العمليات واحدة في كل الدول لا تتغير. فالتأمين عملية فنية تهدف الى تجميع الأخطار وتوزيع الخسائر بين الأطراف المعرضين لهذه الأخطار. من ثَمﱠ وجب البحث في النظام القانوني لعقود التأمين الدولية، وذلك بتحديد ماهية عقد التأمين الدولي، وخصائصه، والقانون الواجب التطبيق على إبرام عقد التأمين الدولي من حيث الشروط الشكلية والموضوعية، وبيان القانون الواجب التطبيق على موضوع عقد التأمين الدولي، ثم تحديد الاختصاص القضائي لمنازعات عقد التأمين الدولي، من خلال توضيح ضوابط الاختصاص القضائي، وأخيراً المحكمة المختصة بنظر النزاع. |
