| Summary, etc. | تنطلق السياسة الجنائية، في عمومها من فكرة مفادها ضرورة حماية الحقوق والحريات في مواجهة الدولة، هذه الضرورة تجعل المشرع الجنائي مطالباً بالتوفيق بين مسألتي حماية حقوق الإنسان، وصناعة التشريع الجنائي، بما يكفل وضع حد للصراع القائم بين حق المشرع في ممارسة سلطة التجريم، وحق الأفراد في احترام حقوقهم وحرياتهم الدستورية. <br/>ومسألة التوفيق بين الحقين المذكورين أمست من المبادئ الدستورية التي تقيد سلطة المشرع الجنائي في مجال التجريم. وهذه المبادئ تنبثق من روح الدستور لارتباطها بالشرعية الدستورية، فيما يتعلق بالقيود التي يفرضها المشرع على الحقوق والحريات الفردية، فمن هذا المنظور يعتبر التشريع الجنائي سلاحاً ذو حدين، فإذا أحسن المشرع استعماله ، كانت الحقوق والحريات في مأمن من التعسف، ومتى أساء استخدامه أدى ذلك إلى الإخلال بالتوازن بين الحماية التي يقررها المشرع للقيم والمصالح الاجتماعية، وبين الحماية الواجبة للأفراد، دون الإخلال بحقوقهم وحرياتهم |

| Summary, etc. | Criminal policy, in general, is based on the idea of the necessity of protecting rights and freedoms in the face of the state. This necessity requires the criminal legislator to reconcile the issues of protecting human rights and developing criminal legislation, in a way that ensures putting an end to the conflict between the legislator's right to exercise the power of criminalization and the right of individuals to respect their constitutional rights and freedoms. <br/>The issue of reconciling the two aforementioned rights has become one of the constitutional principles that restrict the authority of the criminal legislator in the field of criminalization. These principles stem from the spirit of the constitution due to their connection to constitutional legitimacy, with regard to the restrictions imposed by the legislator on individual rights and freedoms. <br/>From this perspective, criminal legislation is considered a double-edged sword. If the legislator uses it well, rights and freedoms are safe from arbitrariness, and when it is misused, this leads to a disruption of the balance between the protection decided by the legislator for social values and interests and the protection due to individuals, without prejudice to their rights and freedoms. |
