خصصت هذه الرسالة الدراسة نفاذ القرارات الإدارية ذات الأثر الرجعي دراسة مقارنة متضمنة مقدمة وفصل تمهيدي وبابين وخاتمة.<br/>والمقدمة أوضحت فيها أهمية الدراسة والهدف منها ، وصعوباتها، ومنهج البحث وخطته ...<br/>أما الفصل التمهيدي فقد أوضحت فيه البناء القانوني والشرعي لفكرة الأثر الرجعي مشتملاً على ماهية الأثر الرجعي، وتمييزه عن غيره من التصرفات القانونية الأخرى التي قد تختلط به .<br/>والمبادئ القانونية التي تحكم هذا الموضوع ، النصل في النهاية إلى طبيعته القانونية والشرعية ، وذلك في كل من القانون الوضعي والفقه الإسلامي<br/>بينما يدور الباب الأول حول مبدأ عدم رجعية القرارات الإدارية في كل من القانون الوضعي والفقه الإسلامي، ودرسنا فيه ثلاثة فصول على النحو التالي :<br/>الفصل الأول : مفهوم مبدأ عدم رجعية القرارات الإدارية .<br/>الفصل الثاني : مبررات مبدأ عدم رجعية القرارات الإدارية .<br/>الفصل الثالث : الأساس القانوني والشرعي المبدأ عدم رجعية القرارات الإدارية .<br/>وإذا كان المبدأ السابق من المبادئ المسلم بها فقها وقضاء ، إلا أن طبيعته لا تأبى الإستثناء<br/>الذي لا يخرجه عن جوهره ، لذا فقد جاء الباب الثاني من هذه الرسالة بعنوان : أحوال إباحة الرجعية في القرارات الإدارية، وقد تناولنا فيه أربعة فصول في كل من القانون الوضعي والفقه الإسلامي ..<br/>وذلك على النحو التالي :<br/>الفصل الأول : القرارات الرجعية بنص القانون، وفيه رجعية القرارات الإدارية تنفيذاً لقانون ذي أثر رجعي ، ورحميتها بتحويل من المشرع ، ثم رجعيتها بإجازة هذا المشرع .<br/>الفصل الثاني : القرارات الرجعية تنفيذاً لحكم الإلغاء ، وقد عالجنا فيه تقرير الأثر الرجعي لحكم الإلغاء ، والنتائج المترتبة على الحكم بإلغاء القرارات الإدارية .<br/>الفصل الثالث : القرارات الرجعية بطبيعتها، ويشتمل على كل من الرجعية المترتبة على سحب<br/>القرارات الإدارية وقيودها، والرجعية التي تتطلبها طبيعة الاختصاص ، أو تلك التي تقتضيها سير المرافق العامة ، والرجعية في القرارات المؤكدة والمفسرة والمصدقة، والرجعية في تصحيح.<br/>القرارات الإدارية المعينة، والرجعية في تحول القرارات الإدارية المعيبة أيضاً .<br/>الفصل الرابع : رجعية القرارات الإدارية الأصلح للأفراد والأصلح للمتهم .<br/>وفيما يتعلق بالخاتمة ، فقد بينت فيها أهم النتائج التي أثمرت عنها الدراسة ، ثم أتبعتها بالتوصيات والمقترحات، وأخيراً فهرس تفصيلي الموضوعات الرسالة .. |

This Thesis was devoted to study the administrative decision, that retroactive effect comparative study the law and islamic jurisprudence and this study was divided into on introduction, a preface, and tow chapters, and a conclusion.<br/>In the preface: I clarified the structure legitimate to idea retroactive effect, including concept of retroactive effect in both the positive systems and islamic jurisprudence, and the distention between retroactive effect, and related terms, and the legal basis of the retroactive effect to reach the end to its nature in the law and islamic jurisprudence<br/>The first part contains principle of non retroactive the administrative decision in both positive systems and jurisprudence, in this the part, I explained three chapters as following:<br/>Chapter one the principle" identification of the non retroactivity of the administrative decisions.<br/>Chapter tow in the target of principle of the non retroactivity of administrative decisions<br/>Chapter three in the legal basis and legitimate from the identification non retroactivity of administrative decisions<br/>If the previous is one of those that have in the jurisprudence and the rule, but its nature doesn't resist that irregular that doesn't remove it from its nature, so was the part tow of this the research title with cases of allowed retroactivity in the administrative decisions this part includes four chapters in law and islamic doctrine as following:<br/>Chapter one: retroactivity of the administrative decision according to legislator text, that including retroactivity of the administrative decisions according to the law.<br/>Chapter two: retroactivity of the administrative decisions according to the rule of canceling, I explained this chapter the report of retroactivity to the rule canceling, and the resulting from the rule canceling the administrative decision.<br/>Chapter three: retroactivity of the administrative decisions according to<br/>its nature that including both retroactivity of the with draw decision, and obstacles, and retroactivity that the nature of the subject needs, or that which concerning public ministers, and the retroactivity in certain and the explained decision also the retroactivity decisions designed, and the retroactivity both administrative decisions in correct bad the decisions and its turning also.<br/>Chapter four: retroactivity of the good administrative decisions for persons, and prisoners.<br/>In the conclusion I explained the most important of the result according to the study, then I following it by some advice and suggestions, finally for the subjects of the message. |
