| Summary, etc. | تعتبر الرقابة القضائية على أعمال الإدارة العامة من أهم وأقوى صور الرقابة إطلاقاً، حيث يعتبر القضاء أكثر الأجهزة القادرة على حماية مبدأ المشروعية، والدفاع عن الحقوق والحريات العامة، خاصة إذ ما كان مرفق القضاء مستقلاً وتوافرت له الضمانات الكافية لذلك، كما أنها تضع الإدارة العامة في وضع متساو مع الطرف المتضرر من جراء القرار الإداري محل الطعن، وتشكل رادعاً من تغول وتسلط السلطة الإدارية عند إصدارها للقرار الإداري، ولممارسة هذه الرقابة لا بد من رفع الدعوى الإدارية أمام الجهة القضائية المختصة، وهي المحكمة العليا بصفتها محكمة عدل عليا بصفتها قضاء إدارياً مؤقتاً وذلك وفقاً للقانون الأساسي الفلسطيني.<br/>وفي هذا الدراسة تناولنا إجراءات رفع الدعاوى الإدارية والفصل فيها وتنفيذ الأحكام القضائية الصادرة عن القضاء الإداري، وطرق الطعن في الأحكام، ومدى جواز الطعن في أحكام محكمة العدل العليا.<br/>ولتقديم دراسة متكاملة حول إجراءات التقاضي أمام القضاء الإداري الفلسطيني، اتبعنا في هذه الدراسة الأسلوب العلمي التحليلي، وذلك من خلال إجراء دراسة تحليلية للنصوص القانونية المتعلقة بإجراءات التقاضي أمام القضاء الإداري، والنصوص المتعلقة بصلاحيات واختصاصات القضاء الإداري، وتحليل الأحكام القضائية الصادرة عن محكمة العدل العليا الفلسطينية والغوص في جزئياتها واستخلاص الآراء الفقهية والقضائية السديدة، وذلك من أجل وضع نظرية عامة لتنظيم إجراءات التقاضي أمام القضاء الإداري.<br/>واتبعنا أيضاً الأسلوب العلمي المقارن، وذلك من خلال مقارنة النصوص القانونية الواردة في قانون مجلس الدولة المصري والذي يسير على النظام اللاتيني، وقانون محكمة العدل العليا الأردنية، بالقوانين الخاصة بالقضاء الإداري الفلسطيني.<br/>واتبعنا أيضاً الأسلوب التأصيلي، وذلك من خلال دراسة التطورات التاريخية التي مر بها القضاء الإداري في فلسطين.<br/>وقد قسمنا هذه الدراسة لثلاثة أبواب يسبقها باب تمهيدي، وأنهيناها بخاتمة تضمنت النتائج والتوصيات التي خلصت إليها ومن أهم التوصيات وجوب قيام المشرع الفلسطيني بسن وإصدار قانون مجلس الدولة الفلسطيني، وقانون إجراءات التقاضي أمام القضاء الإداري، وقانون الإثبات أمام القضاء الإداري، لما لها من أهمية في مجال القانون والقضاء الإداري. |

| Summary, etc. | Judicial control is considered as the most powerful form of control on public administration. This is due to jurisdiction being the most capable of safeguarding rights and public freedoms, especially if the judicial system is sovereign and has sufficient guarantees to perform its duties. Judicial control also puts public administration in an equal position with parties affected by a contested administrative decision, and hence serves as a deterrent for the administrative authority encroachment. To practice this form of control, it is then necessary to present this lawsuit before the competent legal authority; the High Court, which is a temporary administrative court according to the Palestinian basic law. Accordingly, this study looks at the ways to litigate and resolve administrative lawsuits, implement judicial verdicts issued by the administrative justice and ways to appeal them and the possibility of appealing verdicts issued by the Supreme Court of Justice.<br/>To present a comprehensive study on the proceedings of litigation before the Palestinian administrative court, the study has followed the analytical method through analysing legal texts relating to litigation proceedings and other provisions relating to the powers of administrative justice; and analysing deeply judicial rulings issued by the Palestinian Supreme Court of Justice; and accordingly derive sound legal and jurisprudence opinions. At the end this aims at developing a general theory that organises litigation proceedings before administrative justice.<br/>The study has also used a comparative method by comparing legal text contained in the Egyptian Council law (emanating from the Latin/Roman Law) and the laws of the Jordanian Supreme Court to the laws of the Palestinian Administrative Justice. Furthermore, the study has used the inductive method to look at the historical developments of the Palestinian administrative justice.<br/>The study is divided into three chapters preceded by an introduction, and in the conclusion, the research presents the results and recommendations reached. He advises the Palestinian legislator to enact the law of the Palestinian Council of State, the law of litigation before the administrative court and the law of proof of evidence before the administrative justice since these laws are very essential in the field of administrative law and justice. |
