هدفت هذه الدراسة إلى التعرف على الحماية الدستورية لحرمة الحياة الخاصة من خلال دراسة مقارنة بين القانونين الإماراتي والمصري، وقد اتضح أن الحياة الخاصة تمثل الفضاء<br/>الواسع لحرية الإنسان في اختيار أسلوب حياته الشخصية بعيدًا عن التدخل ودون أن يكون في<br/>استطاعة الآخرين الاطلاع على أسرارها أو نشر هذه الأسرار بغير رضائه.<br/>وقد منح القانون الحق للأفراد في حماية حياتهم الخاصة من أي تدخل يمس هذه الحرية أو هذا الحق، بمعنى حماية شخصيته من الاعتداء عليها والحفاظ على استقلاله وسلامته؛ بما<br/>يضمن حريته في التعبير عن نفسه وتصرفاته وفق الآلية التي يرتئيها مناسبة.<br/>ويتحدد نطاق الحق في خصوصية البيانات وفقاً لعاملين أساسيين متنازعين، وهما المصلحة الفردية في حرية الحياة الخاصة وإضفاء السرية على نشاطاتها، والعامل الثاني هو. حق المجتمع في توجيه سلوك أفراده ومعرفة بعض المعلومات عنهم في حدود معينة بوسائل مشروعة ومطابقة للقانون، من أجل حماية مصالح المجتمع المختلفة وعلى رأسها حماية الأمن .<br/>والنظام العام والحق في الإعلام.<br/>وعلى الرغم من الحماية التي فرضتها المعاهدات الدولية والدساتير الوطنية، إلا أنه لا يزال هناك قصور في حماية الحياة الخاصة، فقد أدى التطور العلمي والتكنولوجي في الفترة الأخيرة إلى تجدد وتنوع التقنيات المستعملة في انتهاك حرمة الحياة الخاصة للإنسان، مما جعل من الإنترنت أداة جريمة تسمح بارتكاب العديد من الجرائم الإلكترونية بعيداً عن أعين الجهات الأمنية. وقد أوصت الدراسة بضرورة توفير الحماية الدستورية القوية لكل من الخصوصية<br/>وحرية التعبير دون طغيان أحدهما على الآخر. |

This study aims at identifying the constitutional protection of the sanctity of private life through a comparative study between the UAE and Egyptian laws. It has become clear that private life represents the vast space of human freedom in choosing his personal lifestyle without interference and without being able to read or disseminate its secrets. Secrets without his consent.<br/>The law grants individuals the right to protect their private lives from any interference that infringes upon this freedom or right, in the sense of protecting their character from aggression and maintaining their independence and integrity, thus guaranteeing their freedom to express themselves and their actions according to the mechanism they deem appropriate.<br/>The second factor is the right of society to direct the behavior of its members and to know some information about them in a certain extent by legitimate and lawful means, in order to protect the various interests of society Primarily security, public order and the right to information.<br/>Despite the protection imposed by international treaties and national constitutions, there is still a lack of protection of private life. Scientific and technological development has recently led to the renewal and diversity of techniques used to violate the privacy of human life, making the Internet a crime Many cyber crimes away from the eyes of the security authorities. The study recommended the need to provide strong constitutional protection for both privacy and freedom of expression without tyranny of one another. |
