تتناول هذه الرسالة موضوع المسئولية المدنية عن افعال المنتجات الخطرة ، فهى تبحث فى الأسس التى تستند إليها تلك المسئولية فى إطار المسئوليتين العقدية والتقصيرية ، وذلك بالبحث عن مجموعة من القواعد التى نصت عليها بعض التشريعات العربية وقانون حماية المستهلك المصرى والاتفاقيات الدولية بهذا الخصوص ، مع الاسترشاد بالحلول التى توصل إليها القضاء الفرنسى بغية إعطاء حماية أكبر للمستهلك فى العلاقة مع المنتج .<br/>وقد تطرقت هذه الرسالة إلى دراسة الأساس القانونى للمسئولية التى تقع على عاتق المنتج والآثار المترتبة عليها ، وأظهرت الدراسة أن المسئولية التى تقع على عاتق المُنتج هى أمر فى غاية الأهمية ، إذ يترتب عليها تحديد نطاق هذه المسئولية .<br/>كما تركز هذه الرسالة على ماهية العيب الموجب للمسئولية ، والمحددات القانونية لهذا المفهوم ، وكذلك تبحث فى أحكام ضمان العيوب الخفية ، وتبين مدى ملائمة قواعدها لتعويض المستهلك عما يصيبه من أضرار مادية وجسدية ، وتكشف عن أوجه القصور التى تعترى قواعد الضمان ، وكيف استطاع القضاء الفرنسى يسانده فى ذلك الفقه تطويع قواعد ضمان العيوب الخفية عن طريق تشبيه البائع المهنى بالبائع سىء النية ، وإقامة قرينة على علم البائع المهنى بعيوب منتجاته نظراً لإحترافه وخبرته ومقدرته على كشف عيوب المبيع .<br/>وقد تناولنا حماية المستهلك من أضرار المنتجات المعيبة والخطرة بموجب قواعد المسئولية التقصيرية ، حيث بحثنا فى قواعد المسئولية عن الأشياء ، وكيف قام الفقه الفرنسى بصياغة نظرية تجزئة الحراسة إلى حراسة استعمال وحراسة تكوين بغية إقامة مسئولية المنتج عن أضرار منتجاته بإعتباره حارساً للتكوين الداخلى للمنتج ، وعرضنا لموقف الفقه والقضاء الفرنسى من هذه المسألة. |

This Thesis addresses Civil liability for the actions of defective products and dangerous . It examines the legal grounds, on which consumer protection stands within the framework of contractual and omissive liabilities. Elaborating on a set of relevant rules provided by certain Arab regulations as well as by consumer protection Act Egyptian, the Thesis refers to solutions devised by the French judicial system in order to provide more protection to consumers in their relationship with producers.<br/>We have studied the legal basis for the responsibility of the producer and their implications. And in the end, the study showed that the responsibility lies on the producer is very important, as it results in determining the scope of this responsibility.<br/>The Thesis examines the liability for concealed defects and explains whether respective regulatory rules are compatible to compensating consumers for material and physical damages incurred. Additionally, it explores inadequacies of liability rules and how the French judicial system, supported by jurisprudence, has managed to adapt rules on concealed defects by matching a professional salesperson to one of bad faith. The French judiciary establishes a presumption against the professional salesperson’s awareness of defects in their products in view of their professionalism, experience and capability of detecting defects<br/>of sold objects.<br/>Finally, liability for objects is investigated. The French judiciary theorises that guardianship is partitioned into one of usage and one of composition. As a guardian of internal ingredients of the product, a producers’ liability for damages posed by their products will be established. Having presented the relevant position of Arab judiciary and jurisprudence. |
