تعتبر السلطة اللائحية أحد الوسائل والأسباب في الإسهام التشريعي من جانب السلطة التنفيذية وذلك في ظل الظروف العادية، أو في ظل الظروف الاستثنائية، ونظراً لخطورة السلطة اللائحية أقرت الدساتير المقارنة مجموعة من الضوابط والقيود الدستورية، لإيجاد نوع من التوازن والتعايش بين السلطتين التنفيذية والتشريعية، كما أقرت الدساتير مجموعة من الوسائل القانونية لرقابتها لعدم انحرافها، وضمان مشروعيتها وردها في سلطتها الضابطة لنشاطها وحسن تطبيقها .<br/>وانطلاقاً من هدف هذه الدراسة قسمنا هذه الرسالة إلى بابين متتاليين وارتأينا قبل الولوج في تفاصيل مواضيع هذه الدراسة، أن نخصص فصل تمهيدياً يشتمل على مقدمات ضرورية لابد من الحديث عنها ابتدءا لبيان بعض المفاهيم التي قد تجول بخاطر كل قارئ، فكان لزاماً علينا التطرق لبحث النظام القانوني للسلطة اللائحية، في ضوء التعريف بالسلطة اللائحية من حيث ماهيتها ونشأتها، ومراحل تطورها التي لحقت بها، ومعرفة خصائصها والتمييز بينها وبين السلطة التشريعية - اللوائح والقوانين وصولاً لمعرفة أوجه الشبه والاختلاف بينهما.<br/>وثم اهتمت هذه الدراسة في الباب الأول على الضوابط الدستورية للسلطة اللائحية في الظروف العادية، قائما على أساس ثلاثة فصول، خصصنا الأول منه لبيان التنظيم الدستوري لممارسة السلطة اللائحية التنفيذية، وتناولنا في الفصل الثاني بيان التنظيم الدستوري للسلطة اللائحية المستقلة، ثم جاء الفصل الأخير الدراسة وسائل الرقابة البرلمانية والقضائية وحدود الرقابة الدستورية على السلطة اللائحية في الظروف العادية.<br/>وتناولنا في الباب الثاني من هذه الدراسة الضوابط الدستورية للسلطة اللائحية في حالة الضرورة، وذلك من خلال ثلاثة فصول، استعرضت في الفصل الأول اتساع السلطة اللائحية في حالة الضرورة، وتناولنا في الفصل الثاني التنظيم الدستوري للسلطة اللائحية في حالة الضرورة، وفي ختام هذا الباب جاء الفصل الثالث الدراسة الرقابة على السلطة اللائحية في حالة الضرورة، حيث اقتضت الدراسة بيان حدود ووسائل الرقابة البرلمانية والقضائية على السلطة اللائحية في حالة الضرورة، وأهمية وحدود الرقابة الدستورية على السلطة اللائحية في حالة الضرورة. |

Regulatory authority is considered to be one of the means of legislative contribution by the executive authority, under normal circumstances or the exceptional circumstances, and because of its gravity,the comparative constitutions adopted a lot of constitutional controls and restrictions to find a kind of balance and coexistence between the executive and legislative authorities, the Constitutions have also adopted a set of legal means to ensure that it will not deviate, and to guarantee its legitimacy and response in its control of its activity and good application.<br/>Based on the objective of this study, we divided this research into two consecutive sections, and before entering into the details of the subject of the study, we devoted a preliminary chapter it contains necessary introductions that need to be discussed to illustrate some of the concepts that may be traversed by every reader, we had to address the legal system of the regulatory authority, in terms of definition, nature and origin and the stages of its evolution, and to identify their characteristics and distinguish them from the legislative authority- Rules and Regulations- and to know the similarities and differences between them.<br/>The first section of this study focused on the constitutional controls of the regulatory authority in normal circumstances, based on three chapters, the first one was to clarify the constitutional organization for the exercise of executive authority, in the second section we clarified the constitutional organization of the independent regulatory authority, and finally in the final section of this study we discussed the means of parliamentary and judicial oversight and the limits of constitutional control over the regulatory authority under normal circumstances.<br/>In the second part of this study, we examined the constitutional controls of the regulatory authority in case of necessity, in three chapters, the first chapter to clarify the expansion of the validity of the regulatory authority in case of necessity, the second chapter to illustrate the constitutional organization of the regulatory authority in case of necessity, and at the end of this section came the third chapter to study the control of the regulatory authority in case of necessity, where the study required a statement of the limits and means of parliamentary and judicial control over the regulatory authority in case of necessity, and the importance and limits of the constitutional control of the regulatory authority in case of necessity. |
