قد جاءت أهمية هذا البحث فى مدى الحماية التى يكفلها القانون لحياة الإنسان وجسده، حتى لا يكون ضحية علمه وتقدمه، ونظراً لأن المشرع المصري لم يتعرض لاستخدام هذه التقنية الحديثة بنصوص شاملة، لذا قمنا بإلقاء الضوء عليها مع مقارنة أحكامها بالأنظمة المختلفة وخاصة القانون الفرنسى. وينحصر نطاق هذا البحث فى الجانب الموضوعى، والذى تناولت فيه بالدراسة بعض الموضوعات المرتبطة بالكائن البشرى، فى مفهوم القانون المدنى، واستخدامات التكنولوجيا الحيوية، ويندرج تحت هذا، فكرة الكائن البشرى الجدير بالحماية القانونية من خلال - تحديد نطاق بداية الحماية ونهايتها- وارتباطها بالشخصية القانونية، وكذا نطاق تمتع البويضة الملقحة والخلايا الجذعية بالحماية سواء فى القانون الوضعى أو الشريعة الإسلامية، كما تعرضنا فى هذا البحث لنطاق تحديد نهاية الشخصية القانونية للكائن البشرى، وذلك من خلال إلقاء الضوء على معايير تحديد لحظة الوفاة، وفى رفع أجهزة الإنعاش الصناعى عن المريض. كما أن رسم الحدود القانونية لهذه التقنيات الطبية الحديثة يستوجب فى ظل غياب النصوص القانونية المنظمة لها، الرجوع إلى المبادىء القانونية المستقرة لحماية جسم الكائن البشرى وحرمته بصفة عامة، سيما وقد استقرت عدة مبادىء قانونية هامة تتعلق بحماية جسم الإنسان، ومنها : مبدأ الكرامة الإنسانية، ومبدأ الحرية، ومبدأ الأخلاق، ومبدأ خروج جسم الإنسان عن دائرة التعامل المادى، ومبدأ عدم جواز المساس بجسم الكائن البشرى. |

The importance of this research: the extent of protection of the law for human life and body, so as not to be a victim of his knowledge and progress, and because Egyptian legislator was not subjected to the use of this modern technology comprehensive texts, came so we shed light upon a comparison with the provisions of the various systems, especially French law.
