| Summary, etc. | تناولت هذه الدراسة موضوع أثر تدهور قيمة النقود على الإلتزامات العقدية كدراسة مقارنه بين أحكام القانون الوضعي والفقه الإسلامي.<br/>فبعد أن أصبحت النقود دون قيمه ذاتيه كما كان عليه الوضع قديما عندما كان الأفراد يستخدمون الذهب والفضه ، فالنقود اليوم تقوم على أساس قانوني في إقليم الدوله وعلى أساس التقه للمتعاملين بها خارج ذلك الإقليم، لذا فقد يضطرب سعر النقد وتنهار قيمة العمله مما يؤدي إلى إلحاق العين الفاحش بالدائن وبالذات في الإلتزامات المتراخية التنفيذ<br/>ولما كان المشرع في غالبية الدول ومنها الأردن قد إتجه إلى وضع قاعدة مؤداها عدم الزام المدين إلا بقدر عدد النقود المبينه في العقد. فقد جاءت هذه الدراسة لبحث هذا الموضوع والبحث عن الحلول لتلافي أثر انخفاض قمية النقود على الإلتزامات العقدية وذلك من خلال تحديد مفهوم النقود وذاتيتها وقيمتها وذلك في الفصل التمهيدي . ثم بيان مفهوم تغير قمية النقود وأسباب ذلك التغير واثاره وذلك في الفصل الأول . ثم دراسة المحاولات القانونية لتلافي أثر إنخفاض قيمة النقود وذلك في الفصل الثاني وفي الخاتمة تم استعراض أهم النتائج |

| Summary, etc. | This study deals with the effect of money devaluation on contractual obligations through a comparison between the Jordanian law and Islamic Jurisprudence.<br/>Since the value of money can devalue from time to time, this could prejudice debtor through long-term contracts.<br/>Legislators in most countries, and specifically in Jordan, have put a rule in this regard which does not oblige the debtor to pay more than the<br/>Amount of money illustrated in the contract.<br/>This study begins with an introductory section deals with the concept of money and its value. Section one, deals with the concept of money devaluation and its reasons and effect.<br/>Section two, deals with legal methods of confronting money devaluation.<br/>This study ends with a recommendations. |
