| Summary, etc. | القانون المدنى الاردنى من اول القوانين العربيه التى اخذت بالتفرقه بين المباشر والمتسبب كأسلوب لحدوث الفعل الضار وكنتيجه لهذه التفرقه اختلفت شروط المسئوليه عن الفعل الضار لكل من المباشر والمتسبب ولان الفقه الاسلامى يعتبر المصدر التاريخى للقانون المدنى الاردنى فقد تناولت هذه الدراسه مسئوليه المباشر والمتسبب فى القانون المدنى الاردنى مقارنا بالشريعه الاسلاميه ولم تغفل الدراسه القانون المدنى المصرى بالمقارنه لما لهذا القانون من أهميه كون انه يعتبر من اول القوانين العربيه. br ولهذه الغايه فقد تم تقسيم هذا البحث الى بابين تناول الاول اركان مسئوليه المباشر والمتسبب من فعل ضار وضرر وعلاقة سببية وقسم هذا الباب الى ثلاث فصول تحدث الاول عن الفعل الضار والثانى عن الضرر الموجب للضمان والثالث عن العلاقه السببيه وفى هذه الفصول عرضت الرسالة موقف الفقه الإسلامى ثم ما هو عليه الوضع فى القانون الأردنى مقارنين فى الوقت نفسه بالقانون المدنى المصرى ولم تغفل الرسالة فى ذات الوقت عن إلقاء الضوء على التشريعات العربية المقارنة اما الباب الثانى فقد تحدث عن أحكام مسئولية المباشر والمتسبب وكان ذلك فى فصلين تكلم الاول عن التطبيقات المباشره والتسبب من استعمال الحق الى المسئولية عن الأعمال الشخصية مروراً بالمسئولية عن فعل الغير ختاماً بالمسئولية عن الأشياء أما الفصل الثانى فكان عن أحكام هذه المسئوليه من حيث دعوى الضمان وتقديره الى الاتفاقات المعدلة لأحكام الضمان والتأمين من المسئولية . |

| Summary, etc. | The Jordanian Civil Law is one of the first Arabic laws that distinguished between practicing and causing as a means of doing harmful action. As a result the conditions of responsibility for harmful actions differ as to practitioner and causer. As Islamic jurisdiction is the historical source of Jordanian civil law, this study has dealt with the responsibility of the practitioner and causer in Jordanian Civil Law in comparison to Islamic Law. The study did not forgo Egyptian Civil Law which has a great importance being one of the first Arabic civil laws.<br/>Thus, the study has been divided into two sections preceded by a prelude then a definition of Jordanian Civil Law and its Harmful Action Theory. The first section deals with the elements of the responsibility of practitioner and causer. This section has been divided into three chapters: the first deals with harmful action; the second deals with the action witch entails insurance; the third deals with the action which entails causality. The second section contains two chapters: the first deals with the applications of practicing and causing, and the second deals with the rules of this responsibility. |
