بعد الحمد لله وتوفيقه الذى أعاننى على كتابة هذا البحث فأننى قد بينت التمهيد فى أسباب إختيار الموضوع , إذ أن مقدرة الخصوم على عرض وجهة نظرهم تتفاوت فيما بينهم كما تناولت مدى أهمية الوكالة بالخصومة وذلك من الناحية الإجتماعية والإقتصادية وقد بينت ففى الفصل التمهيدى كيفية تطور الوكالة بالخصومة فى العصور التاريخية والشرائع القانونية وفى الشريعة الإسلامية وقد تبين لنا أن الوكالة بالخصومة لها جذور تاريخية قديمة كما تبين من البحث أن الفقهاء أجمعوا على أن الوكالة هى النيابة عن الغير وقد تبين أن كتب الفقهاء خلت من بيان تعريف للوكالة بالخصومة وتبين أن الوكالة بالخصومة هى إنابة شخصاً أخر لتنفيذيه أمام القضاء وتبين أن فقهاء الشريعة الإسلامية متفقون على مشروعية الوكالة بالخصومة وقد تضافرت الأدلة من الكتاب والسنة والإجماع والمعقول على هذه المشروعية كما تبين أن الفقه الإسلامى والقانون الوضعى يتفقان على أن الوكالة بصفة عامة تنقسم إلى وكالة عامة وخاصة كما أنه من خلال بيان ماهية الموكل فى الفقه الإسلامى والقانون الوضعى تبين أن كلاً منهما يتفقان على ان من جاز لهم التصرف فيه بنفسه جاز ان يوكل فيه وقد تطلب الفقه الإسلامى عدة شروط فى الوكيل بالخصومة وأن الفقه الإسلامى يتفق مع القانون الوضعى فى انه يشترط محل الوكالة أن يكون الموكل فيه معيناً او قابل للتعيين وقد تبين إتفاق الفقه الإسلامى والقانون الوضعى على أن للوكيل بالخصومة سلطة القيام بأعمال الخصومة وإجراءاتها نيابة عن موكله وتلاحظ إتفاق كلاً من الفقه الإسلامى والقانون الوضعى على أنه يجوز الوكيل بالخصومة أن يأخذ أجرة على وكالته وتبين أن الفقه الإسلامى والقانون الوضعى يتفقان فى أن الوكالة بالخصومة عقد جائز وتنتهى بأسباب كثيرة . |

o God and Tawfiqah who helped me to write this research, I have shown the preface to the reasons for choosing the subject, since the ability of the opponents to present their point of view varies among themselves It also dealt with the importance of the Agency to the rivalry, in terms of social and economic In the introductory chapter, I have shown how the agency has evolved in adversity in historical times, legal laws, and in Islamic law. It has been shown to us that the agency in the dispute has historical roots<br/>The research also found that the jurists unanimously agreed that the agency is the prosecution for others. It has been shown that the books of the fuqaha ’have failed to provide a definition of the agency in the dispute. It turns out that the agency in the dispute is assigning another person to the judiciary It was found that Islamic jurisprudents agreed on the legitimacy of the agency in the dispute. The evidence from the book, Sunna,<br/>It was also found that the Islamic jurisprudence and the status law agree that the Agency in general is divided into a public and private agency<br/>It is also through the statement of what the principal in the Islamic jurisprudence and the law of the situation shows that both agree that those who are allowed to dispose of it himself may be entrusted with it<br/>The Islamic jurisprudence required several conditions in the agent of the dispute and Islamic jurisprudence is in accordance with the law of the condition that the agency requires that the agent be appointed or appoint able The agreement of Islamic Jurisprudence and the law of the situation shows that the agent of the adversary has the authority to carry out the acts of dispute and its actions on behalf of his client And notes the agreement of both Islamic jurisprudence and the status law that the agent of the dispute may take a fee on his agency<br/>It turns out that Islamic jurisprudence and the law of the situation agree that the agency’s adversarial contract is permissible and ends for many reasons. |
