حق الملكية يعدُّ من أبرز الحقوق العينية الأصلية وأوسعها مجالاً؛ لما يخوله لصاحبه فقط من مكنة ممارسة مختلف السلطات من استعمال واستغلال وتصرف؛ فمن المُسَلَّم به أن للمرء الحريةَ في التصرف في ملكه كيفما يشاء في استعماله من عدمه، فالأموال من سماتها أنها مملوكةٌ للبشر، موقوفةٌ على حيازتهم، يتصرفون فيها كيفما يشاءون في حدود ما أَذِنَ الله، وعلى الغير احترامُ هذه الحرية وعدم التعرُّض لها، وهذا يعني عدم جواز التصرُّف في ملك الغير دون إذن أو ولاية. فمن الشروط الواجب توافرها في عقد البيع أن يكون الشيء المبيع مملوكًا للبائع، أو مأذونًا فيه من جهة المالك، وان صدر هذا البيع من غير المالك، فإنه ينطبق عليه وصف بيع ملك الغير، والذي يمثل اعتداءً على ملكية المالك الحقيقي. ولكن ان وقع التصرف ببيع ملك الغير فما الحل؟ وما طبيعة الجزاء الذي يلحق هذا النوع من البيوع؟ وهل هذا التصرف ذاته يُشَكِّلُ أيضًا جريمةً جنائيةً يعاقب عليها القانون؟ وما مدى تتطابق أحكام الشريعة الإسلامية مع القانون المدني الليبي في هذا الموضوع؟. لأجل كل ذلك وللإجابة عن هذه التساؤلات التي تمً طرحها ، فقد قمنا بتقسيم خطة الدراسة إلى بابين، يسبقهما فصل تمهيدي، ويتخلهما فصلين لكل منهما، ثم وضعنا خاتمة ً تضمنت أهم النتائج والتوصيات، المستخلصه من هذا البحث. |

The right to property is one of the most fundamental rights in the original and the most extensive field; for the sole author of the exercise of the various powers of the use of exploitation and exploitation; it is recognized that one has the freedom to dispose of his property as he wishes to use it or not. On their possession, acting in it as they wish within the limits of God’s permission, and on others to respect this freedom and not to be subjected to it. This means that it is not permissible to dispose of the property of others without permission or jurisdiction. One of the conditions that must be met in the contract of sale is that the sold item belongs to the seller or authorized by the owner. If this sale is issued by a non-owner, it is subject to the sale of the property of the third party, which constitutes an infringement on the ownership of the real owner. But if the sale takes place, then what is the solution? And what is the nature of the penalty for this type of sale? Does this act itself also constitute a criminal offense punishable by law? How closely do the provisions of the Islamic Shari’a comply with Libyan civil law? In order to answer all these questions, we divided the study plan into two chapters, preceded by a preliminary chapter, and two chapters separated by each. We then concluded with the most important conclusions and recommendations. |
