رفت المجتمعات منذ القدم أشكالًا متعددة ومتنوعة من التعاقد، كالبيع عن طريق التعاقد العادي ومن ثم عرفت فيما بعد التعاقد عن طريق التليفون والفاكس وغيرها، هذا وقد شهد مطلع القرن الحادي والعشرين بزوغ ثورة جديدة هي ”ثورة تكنولوجيا المعلومات والاتصالات”، والتي أسفرت عن تطور هائل في مجال تقنيات الاتصالات سواءٌ الداخلية أو الخارجية حيث قربت المسافات بين التاجر والمستهلك، الأمر الذي أدى إلى ظهور شبكة المعلومات الدولية وما ارتبط بها من تقدم تقني يفوق الخيال، حيث مسَّ هذا التطور كل ميادين الحياة الاقتصادية والعلمية والاجتماعية والطبية والقانونية.<br/>وبعدها ظهرت شبكة الإنترنت إلى حيز الوجود كجانب من جوانب التطور العلمي والتكنولوجي في العصر الحديث التي أبرزت نسيجًا متشابكًا من العلاقات بين الأفراد في مختلف المجالات، وقد أدى هذا التطور لإلغاء الحدود الجغرافية بين الدول المختلفة، وعلى الرغم من أن التجارة الالكترونية وتقديم الخدمات التجارية عن بعد ليس ظاهرة جديدة، إلا أن انتشار الإنترنت على المستوى الدولي قد ساعد في تعزيز هذا النوع من الخدمات فظهر مصطلح التجارة الالكترونية على جميع المستويات والذي أتاح العديد من المزايا، من أهمها تجنيب رجال الأعمال مشقة السفر، وتوفير الوقت والمال والجهد، والسرعة في ترويج المنتجات والبضائع وإمكانية الوصول للمستهلكين في جميع أنحاء العالم، كما تمكن المستهلك من التجوال عبر العالم واقتناء كل ما يريده دون أن يتنقل من مكانه، ومن خلال ذلك كله أصبح الجميع في سوق من العالم الافتراضي مما أدى إلى نمو سوق التجارة الالكترونية بشكل كبير. |
