المسؤولية المدنية لمأمور الضبط القضائي هي مسألة قانونية تتعلق بالتبعية المالية لأفعاله وقراراته التي تسبب ضررا للغير ويتحمل تبعيتها المتبوع له مدنيا وفق أحكام المسؤولية عن فعل الغير . حيث يعتبر مأمور الضبط القضائي شخصًا يعمل على تنفيذ قرارات شبيهه بالقرارات القضائية في إلزامية المتهمين بالحضور والإدلاء بشهادتهم وتسليم أنفسهم وغيره إضافة إلى قيامه بتقديم إجراءات تنفيذية. الجدير بالذكر أن أحد الجوانب الأساسية للمسؤولية المدنية لمأمور الضبط القضائي هو أنه مسؤول عن الأضرار المادية أو المالية التي يتسبب فيها نتيجة قيامه بأعمال التحري في مرحلة جمع الاستدلالات. يجب أن يتحلى مأمور الضبط بالدقة والحذر في أداء واجباته لتجنب أي أضرار غير مبررة للأفراد أو الممتلكات. مفهوم آخر مهم يتعلق بالمسؤولية المدنية هو تفويض السلطة. يعني هذا أن مأمور الضبط القضائي يتحمل المسؤولية عن تنفيذ الأوامر القضائية بشكل صحيح وفي إطار الصلاحيات الممنوحة له فقط. إذا تجاوز سلطته أو انتهك القوانين أثناء تنفيذ الأمر، يمكن أن يتعرض للمسائلة المدنية. هناك أيضًا مصطلح آخر يجب الوقوف عنده عندما نتحدث عن مأمور الضبط القضائي وهو "الإعتداء"، فإذا قام مأمور الضبط بإجراءات غير مبررة أو تجاوز سلطته وألحق أذى بشخص أو ممتلكات، يمكن للأفراد المتضررين مقاضاته للحصول على تعويض. إجمالاً، المسؤولية المدنية لمأمور الضبط القضائي تعتمد على الالتزام بالقوانين واللوائح وضمان تنفيذ القرارات القضائية بدقة ودون إلحاح غير مبرر. في حالة التجاوز عن هذه القواعد، يمكن أن يكون عرضة للمساءلة المدنية ومسؤول عن الأضرار المادية أو المالية التي يتسبب فيها. |

It is worth noting that a fundamental aspect of the civil liability of a judicial enforcement officer is their responsibility for material or financial damages resulting from their investigative activities during the evidence-gathering phase. The enforcement officer must exercise precision and caution in the performance of their duties to avoid any unjustified harm to individuals or property. Another crucial concept related to civil liability is the delegation of authority. This implies that the judicial enforcement officer is accountable for correctly executing judicial orders within the scope of the authority granted to them. If they exceed their authority or violate the law while executing an order, they may face civil litigation. Furthermore, it's essential to consider the term "trespass" when discussing judicial enforcement officers.
