| Summary, etc. | تناول هذا البحث بداية اشكالية هل الإسلام دين فقط ام دين ودوله بمعنى هل الإسلام يحكم علاقة الإنسان بخالقه ام أيضا بين الحكام والمحكومين ؟ وانتهى الباحث إلى ترجيح أن الإسلام دين ودوله<br/>ثم تناول الباحث شروط ترشيح رئيس الدولة في النظام الدستوري المقارن مع النظام الإسلامي ، وانتهى الباحث ان النظام الإسلامي يتفق بشكل كبير مع النظم الغربية بل تخطاها في اشتراط عدالة رئيس الدولة و هذا الشرط غير موجود في النظم الغربية .<br/>ثم تناول الباحث طرق اختيار رئيس الدولة في النظام الدستوري المقارن والإسلامي و انتهى إلى أن النظام الإسلامي لم يحدد طريقه واحده في اختيار الخليفه وإنما تنوعت الطرق بحسب مصالح الناس و ان القاعدة الأساسية هي اختيار و رضا المحكومين بالحكام .<br/>ثم عرج الباحث على سلطات الرئيس التنفيذية ، التشريعية والقضائية و انتهى ان النظام الإسلامي تطابق مع النظم الغربية في اصل السلطات و تفوق عليها في ان القاعدة الأساسية الحاكمة للنظام الإسلامي هي الشورى والتي و ان كانت النظم الغربية تشير إليها الا انها تلعب في النظام الإسلامي دورا أعمق بكثير من دورها في النظام الغربية. |

| Summary, etc. | This research first dealt with the problem of whether Islam is a religion only or a religion and a state in the sense that does Islam govern the relationship of man with his creator or also between the rulers and the ruled? The researcher concluded that Islam is a religion and a state.<br/>Then the researcher dealt with the conditions for the nomination of the head of state in the constitutional system compared to the Islamic system.<br/>Then the researcher dealt with the methods of selecting the head of state in the comparative and Islamic constitutional system, and concluded that the Islamic system did not specify a single method in choosing the caliph, but rather the methods varied according to the interests of the people, and that the basic rule is the choice and consent of those who are governed by the rulers.<br/>Then the researcher looked at the executive, legislative and judicial powers of the president and concluded that the Islamic system coincided with the Western systems in terms of the origin of the authorities and surpassed them in that the basic rule governing the Islamic system is Shura, which although Western systems refer to it, it plays a role in the Islamic system Much deeper than its role in the Western system |
