| Summary, etc. | لقد تطورت السياسة الجنائية إلى أحد أهم المصطلحات الحديثة في الفقه الجنائي المعاصر، وهو مصطلح تفرد العقوبة تناولت هذه الدراسة تطور النظريات الناشئة تاريخيا التي تحاول تفسير فلسفة العقوبة في النظام الجزائي وكيف مهد تطور هذه النظريات لظهور مصطلح التفريد الجزائي، والغرض منها ؟ وكيف تحولت العقوبة من شكلها التقليدي ومبدأ الانتقام والاقتصاص من الجاني ؟ وكيف أصبحت اليوم العقوبة في ظل السياسة الجنائية المعاصرة أداة الإصلاح المحبوس وتهذيبه وإعادة إدماجه اجتماعيا؟<br/>كما تطرقت الدراسة أيضًا إلى تحديد الآثار المترتبة على تفرد العقوبة الجزائية وتقسيم التفريد من حيث التفريد التشريعي والقضائي والتنفيذي، ويشمل انتهاج سياسة تفريد العقاب، وذلك من خلال تدرج العقوبة في النوع والمقدار وكيفية التنفيذ حتى تتلاءم مع حال الجاني وظروف جريمته.<br/>يتم ذلك من خلال اختصاص المشرع بالتفريد التشريعي، وترك السلطة التقديرية للقاضي في تقدير العقوبة، ومن ثم امتداد مبدأ التفريد الى التفريد التنفيذي في المؤسسات العقابية، وذلك كلها ضمن الضوابط القانونية والموضوعية لتحقيق الهدف الرئيسي وهو إصلاح وتأهيل المحكوم عليهم، وإدماجهم من جديد داخل المجتمع.<br/>استخدم الباحث المنهج التحليلي الوصفي المقارن لبيان تفريد العقوبة في القانونين العراقي والمصري والقوانين المقارنة، واختيار العقوبات المناسبة للجريمة، مع الأخذ بنظر الاعتبار واقع الجريمة والجاني |

| Summary, etc. | Criminal policy has evolved into one of the most important modern terms in contemporary criminal jurisprudence, known as the term "individualization of punishment." This study addresses the historical development of theories that attempt to explain the philosophy of punishment in the penal system. It explores how the evolution of these theories paved the way for the emergence of the term "individualization of punishment," its purpose, and how punishment has transformed from its traditional form based on the principles of retribution and retaliation to, in contemporary criminal policy, a tool for the reform, rehabilitation, and social reintegration of the incarcerated.<br/>The study also identifies the effects of individualizing penal punishment and categorizes individualization into legislative, judicial, and executive individualization. This involves adopting a policy of individualized punishment through the gradation of punishment in type, amount, and method of execution to suit the offender's situation and the circumstances of their crime. This is achieved through the legislator's role in legislative individualization, granting discretionary power to judges in sentencing, and extending the principle of individualization to executive individualization within penal institutions. All of these measures are within legal and objective frameworks to achieve the primary goal of reforming and rehabilitating convicts and reintegrating them into society.<br/>The researcher employed a descriptive, analytical, and comparative approach to illustrate the individualization of punishment in Iraqi and Egyptian law and comparative laws. The study selects appropriate punishments for crimes while considering the reality of the crime and the offender. |
