| Summary, etc. | لقد أصبح اللجوء إلى الوسائل البديلة للدعاوى في هذا العصر لحسم وإنهاء المنازعات، أمرا تتطلبه سرعة البت في المنازعات، وتوفير العناصر المتخصصة لنظرها، تمشيا مع ما أفرزه العصر من تطور في ميادين التجارة والخدمات والتقدم التقني، وما يصاحبه من إشكاليات فنية وقانونية معقدة، قد لا يستطيع القاضي المتخصص في المسائل القانونية الإلمام بها، أو إيجاد الحلول المناسبة لفض ما ينتج عنها من<br/>دعاوى، لذا نشأت الحاجة إلى وجود آليات قانونية يمكن للأطراف من خلالها التوصل إلى حل خلافاتهم بشكل سريع ومرض، من خلال مساهمتهم في اختيار الهيئة التي تتولى الفصل في النزاع.<br/>ولقد تبوأت الوسائل الودية لفض المنازعات الإدارية في الوقت الراهن مكانة متميزة، لاسيما في ظل رغبة المتقاضين في إيجاد حلول ودية لنزاعاتهم، بعيدا عن الطريق القضائي الذي ثبت عجزه عن تحقيق<br/>طموحاتهم في عدالة سريعة وفعالة، بفعل تراكم القضايا المطروحة أمام الجهة القضائية المختصة، وطول إجراءات التقاضي وما يتبعه من تضخم في أعداد المنازعات. وتبعا لذلك وجدنا أن هذه العوامل مجتمعة قد ساهمت في تزايد الوعي العام لدى المتقاضين بأهمية هذه الوسائل لتسوية نزاعاتهم، كما دفعت المشرعين إلى ضرورة من قوانين تكرس لحل النزاعات بقدر من السرعة والكفاءة، من أجل الوصول إلى المزايا الكبيرة التي تتحقق من جراء اللجوء إليها، كي نتجاوز أزمة العدالة البطيئة، والتخفيف من حدة الخلل الذي التصق<br/>بالنظام القضائي بشكل عام والإداري بشكل خاص. ونظرا لأهمية الوسائل البديلة في الإسهام الفعال لحل المنازعات فإن كل الدول - في الوقت الحاضر -<br/>ضمنت تشريعاتها النص على استحداث تلك البدائل، ووضعت من الضوابط ما يكفي لقيام الهيئات أو اللجان البديلة بمهامها، حتى تكون تلك الهيئات أو اللجان أداة فعالة لتحقيق العدالة السريعة، وصون الحقوق<br/>بكفاءة، من خلال ممن لهم إلمام بظروف المنازعة وأشخاصها |

| Summary, etc. | Resorting to alternative dispute resolution methods is considered a priority in this era to keep pace with the developments in commerce, services, and technological advancements that require timely-efficient proceedings to resolve disputes in these fields. Especially as there are growing specific technical and legal characteristics of large-scale disputes that cannot be tackled by the traditional means of resolving legal disputes, these specific characteristics necessitate giving the parties the authority to choose the tribunal that will hear the case and resolve it faster than traditional court proceedings.<br/>From the myriad range of legal disputes that could be discussed with alternative dispute resolution techniques, administrative disputes deserve the spotlight. There is a growing concern about the prospect of the usage of ADR in resolving traditional administrative law disputes to provide effective and timely-efficient disputes that traditionally could last longer than expected in light of the growing caseload of the administrative courts. These obstacles to efficient resolution of disputes led to the recognition of the significant role of ADR in resolving administrative disputes; this recognition is widely held by common disputants.<br/>Due to the growing appeal of ADR, legislators have enacted several laws to introduce ADR to talk about the problems of slow justice and growing caseload in the judicial systems generally and the administrative judiciary specifically. There are several laws that establish the legal basis of ADR in administrative disputes, the norms that guide the establishment of the tribunal, and the principles that achieve the supreme ideal of justice in timely and efficient proceedings |
