| Summary, etc. | مرت التشريعات العقابية بمراحل كثيرة لمواجهة ضبط سلوك الأفراد تحت مظلة الدولة، فبعد أن كانت سلطة التشريع في الأنظمة العقابية تتجمع في يد شخص واحد، وهو الملك أو الحاكم الذي يحدد الجريمة والعقوبة بل ويقوم على تنفيذها، فكان الإستبداد والتحكم في حصر مقاليد التشريعات العقابية<br/>في جهة واحدة. ولم يكن لأهداف العقوبة سوى هدف واحد ألا وهو تعذيب وإيلام والمذنب دون التطلع إلى أي أهداف أو أغراض أخرى للعقوبة، وفي بعض الأحيان كان العقاب ينال - ليس فقط من شخص<br/>المجرم - وإنما من أسرته وأصدقاءه المقريبين منه.<br/>واستمرت حياة المجتمعات في هذه المأساة قرونا طويلة من الزمن إلى أن بدأ الإنسان يستشعر ألم التعذيب الذي قد ينال منه ومن أسرته، فبدأ التفكير في التخفيف من وطأة تكريس كل مقاليد السلطة في يد شخص واحد والسعى الى الحد من الاسراف في التجريم حيث تنامى الشعور بقيمة<br/>الفرد والجماعة معا حتى وصلت الأنظمة العقابية إلى معرفة التنوع في العقوبات.<br/>وبطبيعة الحال فإن الإنسان دائما يتطلع إلى كل ما هو أفضل ومفيد للعيش في هذه الجماعة<br/>فالإنسان بطبيعته متمرد - فبدأ في الابتكار والصناعة والتقدم حتى وصل إلى ما وصل إليه العالم الأن من تقنيات علمية متطورة لعلم الحاسوب وكذا الاتصالات عبر شبكة الانترنت والذكاء الاصطناعي، كل ذلك كان دافعاً قوياً للعود لاعادة النظر في صياغة جديدة لتقنين التشريعات العقابية والعمل على<br/>تضييق دائرة التجريم والعقاب بقدر يتماشى مع السياسة الجنائية الحديثة. |

| Summary, etc. | Penal legislation has gone through many stages to confront the control of individuals' behavior under the umbrella of the state. After the legislative authority in penal systems was gathered in the hands of one person, the king or ruler who determines the crime and punishment and even implements it, tyranny and control were in confining the reins of penal legislation to one party.<br/>The goals of punishment had only one goal, which is to torture and hurt the guilty person without looking to any other goals or purposes of punishment, and sometimes the punishment was inflicted - not only on the criminal person - but also on his family and close friends.<br/>The lives of societies continued in this tragedy for centuries, until man began to feel the pain of torture that might be inflicted on him and his family, so he began to think about reducing the burden of devoting all the reins of power in the hands of one person and seeking to limit the extravagance in criminalization as the feeling of the value of the individual and the group together grew until penal systems reached the knowledge of diversity in punishments. Naturally, man always looks forward to everything that is best and useful for living in this community man is rebellious by nature so he began to innovate, manufacture and advance until he reached what the world has reached now in terms of advanced scientific technologies for computer science, as well as communications via the Internet and artificial intelligence, all of which was a strong motivation to return to reconsider a new formulation to codify penal legislation and work to narrow the circle of criminalization and punishment to a degree that is consistent with modern criminal policy. |
