تعد المسئولية الجنائية على قمة المسائل القانونية التي تشغل أذهان الباحثين بالبحث والدراسة وما زالت كذلك، ولا غرو في ذلك؛ فموضوعاتها ما هي إلا ترجمة حية لواقع الحياة من منازعات يومية بين<br/>الأفراد.<br/>ولعل من الموضوعات الحيوية والمهمة في المسئولية الجنائية، التي انتهى بنا المطاف إلى اختياره هو ذلك المتعلق بالمسئولية الجنائية الناشئة عن أعمال البناء والتشييد، فلا يخفى أن هذا الموضوع يكتسب أهميته الكبيرة لما نراه اليوم من تفاقم وتزايد أضرار تهدم المباني يوما بعد يوم حيث تحاط أعمال البناء<br/>والتشييد بالعديد من المخاطر.<br/>والواقع أن المسئولية الجنائية يمكن أن تؤدي دورا مهما وحاسمًا في توفير الحماية للمجني عليه، فلا ريب أن حماية المجني عليه لا يمكن أن تكون فعالة إلا بوضع نظام للمسئولية يحقق الردع والإصلاح<br/>في الوقت ذاته.<br/>فالمباني والمنشآت الثابتة الأخرى هي رمز الاستقرار في الحياة، ويعد بناؤها وتشييدها من قبيل الأعمال المعقدة التي تحتاج إلى مؤهلات علمية وخبرات فنية؛ لذا فإن ما يشوبها من خلل أو عيب يهدد مباشرة حياة الأفراد وسلامتهم، فقد تتعرض المباني خلال عملية تشييدها أو بعد اكتمال هذا التشييد بوقت قصير إلى الانهيار، الذي كثيرا ما يأتي نتيجة للقصور والإهمال من جانب القائمين على عملية البناء من مهندسين ومقاولين وفنيين ومتخصصين، ورغبتهم بتحقيق أكبر كسب ممكن دون اعتبار الأرواح الناس<br/>وسلامتهم والحفاظ على ممتلكاتهم.<br/>ولذلك لم يكتف المشرعون بالقواعد العامة في المسئولية الجنائية في مجال التشييد والبناء، بل قرروا مسئولية استثنائية ذات طبيعة خاصة تتسم بالتشدد الذي يتفق مع خطورة المباني والمنشآت الثابتة الأخرى، وما يسببه تهدمها كليا أو جزئيا، أو ظهور العيوب الجسمية بها التي تهدد سلامتها ومتانتها أو تجعلها غير صالحة لتحقيق الغرض الذي أقيمت من أجله من الإضرار بالاقتصاد القومي، والمساس بالأمن العام والسكينة العامة في المجتمع، ومن تهديد للأفراد في أموالهم وأنفسهم؛ وذلك حتى يكون دافعا للمعماريين إلى بذل كل عناية ممكنة في عملية التشييد والبناء حتى يخرج العقار المشيد سلميا ومتينا، فتتحقق بذلك غاية المشرعين من تشددهم هذا، وهو حماية المصلحة الخاصة والعامة ضد المخاطر<br/>المترتبة على الإهمال المهني الذي تفشى في الأونة الأخيرة في هذا المجال. |

Criminal liability is at the top of the legal issues that occupy the minds of rescarchers in research and study, and it still is, and this is not surprising; Its topics are nothing but a living translation of the reality of life, including daily disputes between individuals. Perhaps one of the vital and important topics in criminal liability, which we ended up choosing, is that related to criminal liability arising from building and construction works. It is no secret that this topic is gaining great importance due to the aggravation and increase in damage caused by the demolition of buildings, day after day.<br/>Building and construction work is surrounded by many risks. In fact, criminal liability can play an important and decisive role in providing protection for the victim. There is no doubt that protecting the victim cannot be effective except by establishing a system of responsibility that achieves deterrence and reform at the same time. Buildings and other fixed facilities are a symbol of stability in life, and their construction is considered a complex work that requires scientific qualifications and technical expertise.<br/>Therefore, any defect or defect in them directly threatens the lives and safety of individuals. Buildings may be exposed during the construction process or shortly after the completion of this construction to collapse, which often comes as a result of shortcomings and negligence on the part of those in charge of the construction process, including engineers, contractors, technicians and specialists, and their desire By achieving the greatest possible gain without regard to people's lives, safety, and preserving their property. |
